December 23, 1958 BIR RULING NO. 705-58 H.E. Heacock Co. 406-407 Dasmarias Manila Gentlemen : In reply to your letter dated December 22, 1958, I have the honor to inform you that your shipment of fountain pens which have gold-filled barrels and nibs and which according to your verbal representations are to be sold at no less than P15.00 a piece is subject to 30% advance sales tax, the same to be based on the total landed cost thereof plus 50% mark-up, pursuant to Section 185(q) of the National Internal Revenue Code. This serves as authority for the Commissioner of Customs in effecting the release of the aforesaid shipment upon the payment of 30% advance sales tax thereon. cdtech Very truly yours, (SGD.)
