December 18, 1987 BIR RULING NO. 408-87 163 (2) 050-87 408-87 Gentlemen : In reply to your letter dated November 13, 1987 please be informed that this Office has already ruled that Potassium Nitrate is a fertilizer and its importation is subject to 10% advance sales tax. This is our definite ruling on the matter. Accordingly, your importation of the aforesaid article is subject to 10% advance sales tax pursuant to Section 163 (2)(m) in relation to Section 162(c), both of the Tax Code, as amended. cdta Very truly yours, (SGD.)
