August 26, 2014 BIR RULING NO. 343 -1 4 National Research Council of the Philippines General Santos Avenue, Bicutan Taguig City Attention: Filemon A. Uriarte, Jr. President Gentlemen : This refers to your letter dated May 20, 2014 requesting for assistance on how the National Research Council of the Philippines (NRCP) may avail of the tax incentives under Act 4120, otherwise known as an Act Creating a National Research Council of the Philippine Islands for the Promotion of Research Work Along Scientific Lines. This law was passed during the Commonwealth Period in 1933, making the NRCP as the first research council in the Asia-Pacific. We regret to inform you that Presidential Decree No. 1931 dated June 11, 1984 has withdrawn the tax and duty exemption privileges, including the preferential tax treatment of all units of government, i.e. , the National Government, its agencies and political subdivisions, as well as the government-owned or -controlled corporations. Corollary to this, Executive Order No. 93 effective March 10, 1987 withdrew all tax and duty incentives granted to government and private entities subject to certain exceptions. IN VIEW OF THE FOREGOING, this Office is of the opinion that the tax incentives granted to National Research Council of the Philippines under Act 4120 have been revoked by subsequent laws.
