July 13, 1988 BIR RULING NO. 312-88 103 (c) 022-88 312-88 Gentlemen : In reply to your letter dated February 18, 1988, please be informed that your importation of 7,500 kilograms of pesticides under L/C No. 85268-F is exempt from the value-added tax pursuant to Section 103(c) of the Tax Code, as amended by Executive Order No. 273 and as implemented under Section 9(3) of Revenue Regulations No. 5-87.(BIR Ruling No. 022-86 dated February 2, 1988) This serves as an authority for the release of said importation from customs custody without payment of the value-added tax.
