July 8, 1993 BIR RULING NO. 295-93 PENSIONS FROM INT'L ORGANIZATIONS EXEMPT FROM PHIL. INCOME TAX 28 (b) (7) (C) 41-87 95-93 Department of Foreign Affairs Manila Attention: Mr . Sime D . Hidalgo Assistant Secretary This refers to your 1st Indorsement dated April 12, 1993 transmitting to this Office the request of the Philippine Mission to the United Nations in Geneva, Switzerland for opinion as to whether pensions of retired Filipino personnel of the United Nations and other international organizations are subject to the Philippine income tax. In reply thereto, please be informed that pursuant to Section 28(b)(7)(C) of the Tax Code, as amended, social security benefits, retirement gratuities, pensions and other similar benefits received by resident or non-resident citizens of the Philippines or aliens who come to reside permanently in the Philippines from foreign government agencies and other institutions, private or public SHALL NOT BE INCLUDED IN THE GROSS INCOME.
