August 23, 1961 BIR RULING NO. 285-61 There are returned to you herewith the papers relative to the internal revenue case of the . . . Company, Fabrica, Sagay, Negros Occidental, with the information that investigation as to the sales tax liability of aforesaid company for the years 1953 and 1954 should be conducted on whatever evidence there is available. Inasmuch as the 5-year period for the preservation of books of accounts has already elapsed, we cannot take any legal action against the taxpayer for failure to produce the same. However, investigation can still be conducted thereon talking into consideration whatsoever secondary evidence there is available. You are, therefore, hereby directed to conduct the necessary investigation without delay and to proceed with the collection of any tax that may be found due from said company. prll
