March 11, 1958 BIR RULING NO. 170-58 Limay Saw Mill Corporation Calabagan, Casiguran Quezon Attention : Mr . D . R . Veneracion, Secretary Gentlemen : This is with reference to your letter, dated March 3, 1958, requesting opinion as to whether or not payment made on the 18th of February by telegraphic transfer to the Municipal Treasurer of Casiguran, Quezon, of the 7% sales tax payable by the Limay Saw Mill Corporation for the month of January and received by said treasurer on the same date, is considered delinquent because of the non-encashment thereof by reason of the lack of the funds of the Postmaster on that date. cdll In reply thereto, I have the honor to inform that percentage taxes are now payable within twenty (20) days after the end of each month, pursuant to Republic Act No. 2025, which took effect on June 22, 1957. Since the telegraphic transfer sent by you to the Municipal Treasurer of Casiguran, Quezon, to cover the 7% sales tax due from the Limay Saw Mill Corporation for the month of January was received on the 18th of February, payment is deemed received by the deputy provincial treasurer as of that date. This is for the reason that remittance of money by telegraphic transfer is actually paid for and ordinarily the amount covered by the remittance is available at the place of destination. This Office is, therefore, of the opinion that the tax in the instant case was paid on time. The Municipal Treasurer of Casiguran, Quezon, has been advised accordingly. llcd Very truly yours, (SGD.)
