April 21, 1988 BIR RULING NO. 159-88 103 (c) 000-00 159-88 Gentlemen : This refers to your letter dated April 11, 1988 requesting in behalf of your client, O.S.I. Aquamarine Corporation, a ruling as to the rate of tax applicable on the latter's future importation of "Red Jungle Brand" Brine Shrimp Eggs, a nutritious food for tiny shrimp and fish. In reply, please be informed that the aforesaid future shipment of your client which falls within the purview of fish feeds is exempt from the value-added tax pursuant to Section 9(b)(3) of Revenue Regulations No. 5-87 implementing Section 103(c) of the Tax Code, as amended by Executive Order No. 273.
