July 2, 1990 BIR RULING NO. 127-90 25 (q) 11-90 127-90 Gentlemen : This refers to your letter dated April 19, 1990 stating that the Philippine National Red Cross (PNRC) has been authorized under Presidential Proclamation No. 12, signed by President Corazon C. Aquino, conduct its 1990 Fund Campaign and Membership Drive; that as one of its fund raising activities, PNRC will sponsor the "Big Bang sa Alabang" carnival slated from November 24, 1990 to January 7, 1991 in a vacant lot in front of the Ayala Alabang Village, Muntinlupa, Metro Manila; and that pursuant to Section 4 paragraph b of P.D. No. 1264, the PNRC shall be "exempt from the payment of all duties, taxes, fees, and other charges of all kinds in its benefits and fund raising drives all provisions of law to the contrary notwithstanding." Based on the foregoing, you request a ruling on the tax exemption of the proceeds to be generated from the aforementioned carnival sponsored by the PNRC. In reply, please be informed that pursuant to Section 4 par. b of P.D. No. 1264 as aforequoted, the proceeds to be derived from the "Big Bang sa Alabang" carnival sponsored by the PNRC, as part of its annual fund raising campaign authorized under Presidential Proclamation No. 12, are not subject to income and amusement taxes. cdtech Very truly yours, (SGD.)
