July 3, 1985 BIR RULING NO. 106-85 129-a-3 108-84 106-85 Gentlemen : This refers to your letter dated May 13, 1985 requesting exemption from the payment of donor's tax on the donation of two (2) parcels of land both located in the City of Manila, viz: (1) covered by TCT No. 119776 containing an area of 426.60 square meters more or less: and (2) known as Lot No. 18 of Block 856 of Cadastral Survey of City of Manila situated in the NW line of Calle San Antonio District of Paco containing an area of 810 square meters more or less made by your client, Philippine Baptist, SBC, Inc. in favor of the Paco Baptist Church of Manila, Philippines, a religious corporation duly organized under Philippine laws. In reply thereto, I have the honor to inform you that since the donee is a religious corporation, the aforementioned donation is exempt from the donor's gift tax pursuant to Section 123(a) (3) of the Tax Code, as amended subject to the condition that not more than 30% of said gift shall be used by the donee for administration purposes. cdti Very truly yours, (SGD.)
