April 2, 1987 BIR RULING NO. 095-87 163 (2) 000-00 095-87 Gentlemen : In reply to your letter dated December 17, 1986, please be informed that "Bando" Raw Edge Powerflex Fan Belts which are used for passenger cars, trucks and passenger buses come within the purview of the phrase "spare parts and accessories" as used in Section 163(2)(n) of the Tax Code, as amended by Executive Order No. 36. Accordingly, for undertaking the importation of said articles, you are subject to 10% advance sales tax based on the total value used by the Bureau of Customs in determining tariff and customs duties, including customs duties and other charges, pursuant to Section 162(c) in relation to Section 163(2), both of the Tax Code as amended. Likewise, for engaging in the original sale of the said imported articles, your are subject to the annual fixed tax of P200.00 in accordance with Section 161(1) of the Tax Code.
