April 4, 1961 BIR RULING NO. 088-61 The Acting City Mayor Cebu City S i r : Reference is made to your radiogram, requesting information on the matter of paying the income tax due from corporations. LLjur In answer thereto, I have the honor to inform you as follows: When the tax due is P500.00 or less, the same shall be paid in full at the place where the income tax return was filed. On the other hand, when the tax due is in excess of P500.00 and the taxpayer does not elect to pay the same in installments, it shall also be paid in full at the place where the return was filed. However, if the taxpayer elects to pay in installments, the first installment shall be paid at the place where the return was filed, while the second installment may be paid to the place derived by the taxpayer. In this connection, it may be stated that, in the case of domestic corporations, the return shall be filed with the Commissioner of Internal Revenue, provincial revenue officer, or with the treasurer of the province, city or municipality in which is located the principal office of the corporation where its books of accounts and other date from which the return is prepared are kept, and in the case of foreign corporations, with the Commissioner of Internal Revenue, provincial revenue officer, or with the treasurer of the province, city or municipality in which is located its principal place of business in the Philippines, or if it has no office of any kind or agency in the Philippines, then with the Commissioner of Internal Revenue in Manila (Sec. 46(c), Tax Code). It may also be stated that the income tax is permitted to be paid in installments only when the amount thereof is over P500.00, in which case the law allows the taxpayer to pay the same in the equal installments (Sec. 51(a)(1) & (2), (Ibid).
