February 10, 1961 BIR RULING NO. 078-61 Federal Pharmacy 355 Quezon Blvd. P.O. Box 337 Manila Attention : Mr . Luis Lim Manager Gentlemen : In reply to your queries propounded in your letter dated August 18, 1960, I have the honor to inform you as follows: As commercial broker, earning commission on indent orders, you are required to make a true and complete return of your gross monthly compensation or profit and within 20 days after the end of each month, pay the 6% percentage tax due thereon. [Secs. 183(a) & 195, NIRC] However, if you failed to earn any compensation or profit from your business as a commercial broker for a certain month or months of the year, you may not be required to file a return for said particular month or months or give notice or information to that effect with the proper revenue office concerned. Accordingly, if you are paying the percentage tax for a certain month wherein commissions were earned but no commissions were earned during the previous month or months, a certification of the absence of income in the previous month or months should be incorporated in the statement for the taxable month. cdta Very truly yours, (SGD.)
