Deed of Absolute Sale of Unregistered Land

February 9, 1959 BIR RULING NO. 073-59 The Regional Director BIR Regional District No. 7 Cebu City S i r : This is in connection with the Deed of Absolute Sale of Unregistered Land executed by Mr. Baudillo Torrefranca of Sagbayan, Bohol in full settlement of his income tax for the year 1952 in the amount of P190.00 which was referred to this Office for appropriate action. In this connection, please be informed that internal revenue taxes can only be paid in cash and not in kind. However, if the taxpayer fails to pay the tax due from him, our Office can issue warrants of distraint and levy against real as well as personal property of the taxpayer. Inasmuch as the taxpayer had voluntarily offered his real property there is no need to distrain the same. Arrangement should be made by that Office for the sale at public auction of the property in question. The sale of the property to the successful bidder should, however, be made in the name of Mr. Baudillo Torrefranca. The proceeds of the sale shall in turn be delivered to the treasurer in payment to his tax liability.
