Fernando City Mayor Marikina City, Metro Manila S i r : This refers to your letter dated December 20, 1997, requesting exemption in behalf of Solid Homes, Inc., from the payment of donor's tax in the amount of P14, 934, 250.00 on its donation of an open space located at Loyola Grand Villas in favor of the City of Marikina. In reply, please be informed that since the donee is a political subdivision of the National Government, the aforementioned donation of an open space by Solid Homes, Inc. is exempt from the payment of donor's tax pursuant to Section 94 (a) (2) of the Tax Code, as amended.
