Josefino Punzalan Vice-President This refers to your letter dated December 8, 1992, in effect, requesting confirmation of your opinion that your importation and distribution of Xylole, a chemical used in the manufacture of pesticides is exempt from VAT. casia Documents show that you are a regular local supplier of Xylole solvent for Monsanto Philippines, Inc., Marsman & Co., Inc. and Planters Products, all of which us the said chemicals as raw material in the formulation of pesticides. In reply, please be informed that pursuant to Section 103(c) of the Tax Code, your importation and sale of Xylole shall be exempt from VAT subject to the following conditions: 1. That you are a duly accredited importer of Xylole as determined by the Fertilizer and Pesticide Authority; 2. That you will execute an affidavit indicating the name and address of your purchaser-manufacturer; 3. That you have a regular record of your importation and sale of Xylole or other chemicals to be used in the formulation of pesticides upon receipt of this letter, indicating therein the date, quantity of sales, and name and address of purchaser-manufacturer; and 4.
