Wong Proprietress Gentlemen : This refers to your letter dated December 28, 1994, in effect, requesting for a confirmation of your opinion that your importation of soya beans which is covered by Invoice No. 94-699, dated December 19, 1994 and Bill of Lading No. HKGMNL607/01, dated December 23, 1994 and which arrived in the Philippines via the vessel "Trade Hope" on Voyage No. 1473, is exempt from value added tax (VAT). LexLib In reply, please be informed that soya beans in its original state is exempt from VAT whether used as food for human consumption or as raw material in the manufacture of animal feeds as provided for under Section 103(b) and (c), of the Tax Code, as amended. Such being the case, your importation of soya beans in its original state is exempt from VAT. This serves as your authority to cause the release of the aforesaid importation from customs custody without the payment of the VAT. This ruling is being issued on the basis of the foregoing facts as represented. However, if upon investigation, it will be disclosed that the facts are different, and/or any of the requirements imposed in this letter is not complied with, then this ruling shall be considered null and void.
