Gentlemen : This refers to your letter dated August 20, 1980 requesting confirmation of your opinion that you are exempt from the payment of the 3% publisher's tax, as the publisher of a technical magazine, The Philippine Architecture, Engineering and Construction Record published since 1953. aisadc In reply, I have the honor to inform you that a perusal of your publication, show that it appears at regular intervals with fixed prices for subscription and sale; that it contains editorials, news and other featured articles; and that it is not devoted principally to the publication of advertisements. Consequently, the foregoing publication is exempt from the 3% publisher's tax pursuant to Section 205(15) of the National Internal Revenue Code, as amended. Very truly yours, ROMULO M.
