January 15, 1993 BIR RULING NO. 032-93 SALE/EXPORT OF BANANAS VAT EXEMPT 103 (b) 072-88 032-93 Philippine Banana Growers & Exporters Association 145 Rizal Street, Davao City This refers to your position paper, in effect, requesting for a ruling as to whether your sale of bananas to the exporters is zero rated or exempt from the value-added tax. In reply, I have the honor to inform you that pursuant to Section 103(b) of the Tax Code, sale, or importation of agricultural and marine food products in their original state shall be exempt form value-added tax in all stages of distribution. Accordingly, if you sell bananas in their original state to the exporters, you are not subject to VAT. cd JOSE U. ONG Commissioner of Internal Revenue
