January 31, 1990 BIR RULING NO. 011-90 26 (g) 220-89 011-90 Gentlemen : This refers to your letter dated December 7, 1989 stating that the Philippine National Red Cross (PNRC) has been authorized under Presidential Proclamation No. 12, signed by President Corazon Aquino on May 14, 1986, to undertake the 1989 Fund Campaign and Membership Drive; that as one of its fund raising activities, PNRC sponsored the "Big Bang sa Alabang" carnival slated from November 26, 1989 to January 7, 1990 in a vacant lot in front of the Ayala Alabang Village, Muntinlupa, Metro Manila; and that pursuant to Section 4, par. b of P.D. No. 1264, the PNRC shall be exempt from the payment of all duties, taxes, fees, and other charges of all kinds . . . in its benefits and fund raising drives all provisions of law to the contrary notwithstanding. Based on the foregoing, you request a ruling confirming the tax exemption of the proceeds generated from the aforesaid carnival sponsored by the Philippine National Red Cross. In reply, please be informed that pursuant to Section 4, par. b of P.D. No. 1264 as aforementioned, the proceeds derived from the "Big Bang sa Alabang" carnival sponsored by the Philippine National Red Cross, as part of its annual fund raising campaign authorized under Presidential Proclamation No. 12, are not subject to income and amusement taxes.
