August 9, 2006 BIR RULING [DA-486-06] RMC No. 3-2001; M-192-95 Filocean Export Corporation Km. 17 Cervantes Street, South Super Hi-way 1700 Paraaque City Gentlemen : This refers to your unsigned letter dated March 3, 2005 relative to your request for the cancellation of M-192-95 dated November 6, 1995 (authority to computerize books). It is represented that you would like to revert back to manual recording of your transactions in your books of accounts for the year 2005 since the Board of Directors made a resolution to cease its operation last June, 1997; that you continuously conform with the registration of books of accounts despite the financial position of the company, reportedly non-operation up to the present; that Revenue District No. 52 informed you that non-compliance of renewal of permit to use loose leaf books of accounts will be subject to compromise penalty; and that you request that your pre-numbered loose leaf cash disbursement book for the year 2004 be exempt from the aforementioned penalty. In reply, please be informed that regrettably, this Office cannot grant your request that BIR Ruling No. M-192-95 dated November 6, 1995 be cancelled or revoked as this would defeat the very purpose of computerization, which is easy verification, and availability of information. Pursuant to Revenue Memorandum Circular No. 3-2001 dated January 31, 2001, all Regional Directors, including those who are in acting capacity, are given the authority to grant your request for the use of loose-leaf invoices/receipts and books of accounts (manual). You may thus direct a separate request to the Regional Director concerned for this purpose. As regards your request that you be exempt from the payment of penalties for non-compliance, this Office cannot grant your request for lack of legal basis.
