December 29, 2000 BIR RULING [DA-444-00] 1st Indorsement August 17, 2000 Respectfully forwarded to the Honorable, The Secretary of Finance, Manila, the within letter dated July 25, 2000 of Director Oscar D. Abando, Legal Service, Department of Public Works and Highways addressed to that Department, bearing on the request of Mr. Panya Visetnut, authorized representative of Italian-Thai Development Public Company Limited, for exemption from VAT and ad valorem tax of the following: (1) 5 units 4 x 4 Pick-up (2) 3 units 4 x 4 Utility vehicle to be supplied as vehicles for the engineers under contract for the Construction/Improvement of Sub-projects in the Province of Iloilo under the Rural Road Network Development Project Phase II, Package VII. IETCAS The request for exemption is based on Clause 54.1 Volume I, Part II of the Contract which allows the Contractor to import Construction Plant and Equipment free of customs duty provided the Contractor enters into a re-export bond or Bank guarantee acceptable to the Bureau of Customs in lieu of customs and excise duties.
