August 22, 2000 BIR RULING [DA-317-00] 106 (A) (2) (a) (1) PM Exim Network International G-3 Maerlma Condominium 1666 Escuela St. Cor. EDSA Makati City Attention: Mr . Alberto C . Karingal President Gentlemen : This refers to your letter dated April 23, 1999 requesting for a ruling confirming your entitlement to the benefit of zero percent (0%) VAT on your export sales. It is represented that you are an enterprise engaged in the manufacture and export of rattan furniture and registered with the Bureau of Internal Revenue on July 8, 1997 under Certificate of Registration No. RDO Control #97-500-005793; that you export at least 70% of your output; that the proceeds of such export sales are remitted inwardly through the banking system in the Philippines; and you are registered with the Board of Investments (BOI) on March 18, 1999 with Certificate of Registration No. EP 99-022. In reply, please be informed that you are subject to 0% VAT on your aforesaid export transactions pursuant to Section 106(A)(2)(a)(1) of the Tax Code of 1997. This ruling is being issued on the basis of the foregoing facts as represented. However, if upon investigation, it will be disclosed that the facts are different then this ruling shall be considered null and void.
