December 06, 2001 BIR RULING [DA-258-01] Hon. Sergio G. Edeza National Treasurer Roxas Boulevard Corner Vito Cruz Street Manila S i r : This refers to your letter dated November 16, 2001 seeking confirmation that the terms "US-Dollar Linked Peso Notes Program" and "US-Dollar Indexed Philippine Peso Notes" referred to in BIR Ruling No. 052-2001 dated November 16, 2001 pertain specifically to the proposed issuance by the Republic of the Philippines of "US-Dollar Linked Philippine Peso Notes PHP30 Billion Programme" consistent with the mandate by the Department of Finance to Joint Financial Advisors, Issue Managers and Arrangers. In reply thereto, the use of the term "US-Dollar Linked Peso Notes Program" was in reference to the letter request itself, which was, however, specifically described as "US-Dollar Indexed Philippine Peso Notes" in the draft of the Principal Terms and Conditions of Tranche I attached to the letter and both apparently refer to the issuance of the "PHP30 Billion US-Dollar Linked Peso Notes Program". Unless the Bureau of Treasury intends to issue two different notes and interchangeably use the terms, this Office confirms that both terms pertain to the Issuance of the US-Dollar Linked Philippine Peso Notes PHP30 Billion Programme.
