House Bill No. 5660 entitled "An Act Mandating the Bureau of Internal Revenue to Submit to the Office of the President and Congress a Detailed Report on Tax Collection"

De Ocampo Department of Finance FROM : Commissioner Liwayway Vinzons-Chato Bureau of Internal Revenue SUBJECT : House Bill No. 5660 entitled "An Act Mandating the Bureau of Internal Revenue to Submit to the Office of the President and Congress a Detailed Report on Tax Collection" This refers to the memorandum of Ms. Celenita V. Francisco (Special Assistant, OSEC) dated May 21, 1996 requesting for our comments on the above-captioned House Bill No. 5660 being endorsed by Congressman Gary B. Teves, who is seeking the Honorable Secretary's assistance in urging the President to certify the said bill as an urgent instead of a just priority measure. In this connection, please be informed that Section 18 of the National Internal Revenue Code clearly states the "Contents of the Commissioner's Annual Report", viz: SEC. 18. Contents of Commissioner's annual report . The annual report of the Commissioner of Internal Revenue shall contain a detailed statement of the collections and disbursements of the Bureau with specifications of the sources of revenue and classes of disbursements. This Office is of the opinion therefore that the passage of the subject House Bill No. 5660 would just be a surplusage because of the aforestated existing provision in the Tax Code. What is needed perhaps is a more detailed implementing rules and regulations of the aforequoted section stating the pertinent provisions in the subject HB No. 5660 and not a new law. cdtech LIWAYWAY VINZONS-CHATO Commissioner of Internal Revenue
