April 17, 1997 BIR RULING [DA-184-97] Ms. Salvacion M. Arlante Head, University Archives and Records Depository Section Diliman, Quezon City M a d a m : This refers to your letter dated January 16, 1997 requesting exemption from the payment of donor's tax on the donations of personal papers/collections and cash to the University Archives and Records Depository of the University of the Philippines Main Library to maintain and preserve these papers deposited in a special account number with the UP Accounting Office. In reply, thereto, please be informed that since the donee is a government institution established by Act No. 1870 as amended, the aforesaid donations are exempt from the payment of donor's tax pursuant to Section 94(a)(2) of the Tax Code, as amended.
