April 27, 2001 BIR RULING [DA-073-01] MEMORANDUM FOR : ACIR Nora E. Tamayo Assessment Service FROM : ACIR Milagros V. Regalado Legal Service SUBJECT : Request for Legal Opinion on Confidentiality of Information under the Social Security Law DATE : April 5, 2001 Relative to your Memorandum dated March 29, 2001 requesting for the opinion of this Office on whether or not the Memorandum of Agreement dated November 15, 1995 entered into by and between the BIR and SSS violates Section 24 of the Republic Act No. 1161, "Social Security Act of 1954", please be informed that the issue falls within the jurisdiction of the Office of the Secretary of Justice. Section 67 of Executive Order No. 292, "The Administrative Code of 1997", dated July 25, 1987, provides that: "SEC. 67. Disputes Involving Questions of Law . All cases involving only questions of law shall be submitted to and settled or adjudicated by the Secretary of Justice as Attorney-General of the National Government and as ex officio legal adviser of all government-owned or controlled corporations. His ruling or decision thereon shall be conclusive and binding on all the parties concerned."
