Maglanque General Manager Gentlemen : This refers to your letter dated November 27, 1997 requesting this Office to confirm that BIR Ruling No. 176-95 dated October 25, 1995 to the effect that the importation of comics like Archie Digest, Marvel Comics, Diamond Comics, Image Comics and other illustrated comics magazines is exempt, is still valid. In reply, please be informed that the importation of the above magazines remains exempt from value-added tax pursuant to Section 109(y) of the Tax Code of 1997. cdll Accordingly, BIR Ruling No. 176-95 is still valid and subsisting unless revoked by this Office.
