January 20, 2000 BIR RULING [DA-040-00] Ms . Myrna E . Sobremente Chief, Accounting Division M a d a m : This refers to your letter dated November 12, 1999 requesting for instruction if you can issue to Ms . Veronica S . Lim copy of the latest payroll and certification of the monthly salary of Mr. Henry Sy, Jr., Information System Analyst III assigned at the Field I Technical Support Division, this Bureau. It appears that Ms. Lim, the biological mother of Maria Angelica L. Sy and John Vincent L. Sy, has filed a Petition for Support with Motion for Support Pendente Lite against Mr. Sy which is now pending before the Regional Trial Court, Branch 107, Quezon City. cdlex In connection therewith, please be informed that Support Pendente Lite is provided for under Rule 61 of the New Rules of Court, the pertinent provisions of which read: SEC. 1. Application . The plaintiff, at the commencement of the proper action, or at any time afterwards but prior to final judgment, may file an application for support pendente lite, stating the grounds for the claim and the financial conditions of both parties, and shall be accompanied by the affidavits, depositions or other authentic documents in support thereof. You may, therefore, furnish Ms. Lim the desired documents which will aid the Court in determining the financial condition of Mr. Sy and in fixing the amount of money to be provisionally paid to his minor children Maria Angelica and John Vincent, both surnamed Sy.
