January 31, 1972 Mathay, Batungbacal & Associates Attorneys and Counsellor at-Law Magdalena Building 202 E. Rodriguez Blvd. Quezon City Attention: Mr . Ismael Mathay, Jr . Gentlemen : This refers to your letter dated January 26, 1972 requesting that the products of your client A. A. Yguico Industrices, Inc., namely: Dandricide Concentrated, Dep Medicated Hair Styling Gel for men, Dep Medicated Hair Styling Gel for women, Parley Medicated Creme, and Dep Medicated Creme, be subjected to the 7% sales tax under Section 186 of the Tax Code as medicated preparations. In reply, I have the honor to inform you that it appearing in the report of analysis made by the Food and Drug Administration as shown by the certification of the Administrator thereof dated January 20, 1972, that the abovementioned products of your client are medicated, it is the opinion of this Office that said products are subject to the 7% sales tax pursuant to Section 186 of the Tax Code as medicated preparations.
