January 14, 1974 The Revenue District Officer Revenue District No. 26 Quezon City S i r : This refers to the question of whether or not private market vendors may be exempted from the requirement of issuance of sales invoices which public market vendors are enjoying under existing law. cdta In reply, you are informed that, considering that private markets are operating exactly in the same manner as public markets and, therefore, the considerations for the exception granted to public market vendors equally apply to private market vendors, this Office is inclined to exercise its discretionary power granted by Sec. 204 of the Tax Code, as it is hereby deemed exercised, to extend the exception to private market vendors. In this connection, your attention is called to the scope of the exception in that it is extended only to those vendors selling exclusively domestic meat, fruits, vegetables, games, poultry, fish and other domestic food products. acd Be guided accordingly.
