Tang Vice-President Gentlemen : This refers to your letter dated December 11, 1972 requesting that your importation of 92 cartons of industrial ventilators or exhaust fans with replacement parts be released from customs custody upon payment of the 7% advance sales tax with a 25% mark-up. cd In reply, I have the honor to inform you that it appearing in the brochure submitted that the imported industrial ventilators or exhaust fans are of the reverse type which expel stagnant air and smoke in restaurants, theaters and other industrial establishments, the same are subject to the 7% advance sales tax based on the landed cost thereof plus 25% mark-up, pursuant to Section 183(b) in relation to Section 186, both of the Tax Code. cdt Very truly yours, MISAEL P.
