December 22, 1969 Mr. Angel C. Cruz Second Floor, Magsaysay Building Manila S i r : With reference to your letter of even date, I have the honor to inform you that subsection (j) of Section 185 of the Tax Code had been repealed by Republic Act No. 6110. In view of the foregoing, the shipment of photographic equipment and supplies in favor of your client, Kodak Philippines, Ltd., is now subject to only 7% tax under Section 186 of the Tax Code. This will serve as authority for the Commissioner of Customs in effecting the release from customs custody of the shipment in question upon the payment of only 7% advance sales tax and without the requirement, as previously imposed by this Office, of the filing of a surety bond to answer for the tax difference between the 7% and 40% sales tax in case it shall be verified later that subsection (j) of Section 185 of the Tax Code had not been repealed. cdlex Very truly yours, (SGD.)
