Abela Tax Division Gentlemen : This refers to your letter dated July 29, 1970 requesting that the importations of your client, Atlantic, Gulf and Pacific Company of Manila, Inc. of copper tubes for its own use in the various constructions and contract jobs handled and to handled by it be subject to the 7% compensating tax. In reply, I have the honor to inform you that copper tubes are subject to the 7% sales tax. Consequently, the importations of your client of copper tubes to be used by it in its constructions and contract jobs handled and to be handled by it be subject only to the 7% compensating tax pursuant to Section 190 in relation to Section 186, both of the Tax Code, as amended by Republic Act No. 6110. This superseded Authority to Release Imported Goods Nos. BT-014294 and BT-014293, both dated July 8, 1970, and BT-013020 dated June 23, 1970. Very truly yours, MISAEL P.
