Estacio Gentlemen : This refers to your letter dated March 11, 1969, requesting exemption from the payment of the fixed and percentage taxes on your receipts from the sale of Agro-Industrial Guide Magazine in accordance with Section 191 of the Tax Code. In reply, I have the honor to inform you that upon examination of the contents thereof, the aforecited magazine is found to contain articles of general interest, including editorial features on agriculture, and that the magazine is not devoted principally to the publication of advertisements (as in fact it contains no advertisements). It also appears that the magazine is issued at regular intervals (bi-monthly) with fixed prices for subscription and sale. In view of the foregoing, this Office believes as it hereby holds that the publication of said magazine is exempt from the payment of the 3% tax prescribed by Section 191 of the Tax Code.
