Delfin del Mundo Managing Director Gentlemen : This refers to your letter dated March 2, 1977 requesting re-conformation of our ruling dated October 27, 1975 holding that your importation of Sanyo industrial vacuum cleaners is subject to the 7% advance sales tax, the tax to be based on the landed cost thereof plus 25% mark-up, pursuant to Section 183(b) in relation to Section 186, both of the Tax Code. Your request is premised on the fact that you have an importation of the same articles pending release at the customs. In reply, please be informed that your importation of Sanyo industrial vacuum cleaners which appear in the brochure submitted to be the same type as those subject or our ruling dated October 27, 1975, remains subject to the 7% advance sales tax with a 25% mark-up pursuant to Section 183(b) in relation to Section 186, both of the Tax Code.
