February 19, 1969 Mr. Petronilo Gaitos, Jr. Operation Manager National Housing Corporation 9th Floor, PLDT Building Legaspi St., Makati, Rizal S i r : This refers to your letter dated February 18, 1969, requesting that a certification be issued by this Office to the effect that your importation of two (2) Cement Sheets for the exclusive use of the National Housing Corporation as sample which is not intended for re-sale, barter or exchange is exempt from internal revenue taxes. In reply, I have the honor to inform you that your request cannot be granted for lack of legal basis. Accordingly, the imported articles are subject to the 7% compensating tax pursuant to Section 190 in relation to Section 186, both of the Tax Code. cdtech Very truly yours, (SGD.) MISAEL P.
