Ground Floor, Sarmiento Bldg. 6782 Ayala Avenue, Makati Rizal S i r : With reference to your letter dated July 22, 1976 relative to your request for a ruling exempting you from the payment of compensating tax and customs duties on your importation of construction equipment to be used exclusively in the prosecution of your contract with the Department of Public Highways, please be advised that the contract you entered into with the Department of Public Highways is necessary for the determination of whether you are exempt from the compensating tax on your importation of the aforementioned equipment. Accordingly, it will be appreciated if you can furnish this Office with a copy of said contract in order that appropriate action may be taken on your abovementioned request. As regards your request for exemption from customs duties, you are advised to file your request with the Commissioner of Customs. Very truly yours, EFREN I.
