November 24, 1976 The President Directric Industries, Inc. 255 Kanlaon Street Mandaluyong, Rizal S i r : This refers to your letter dated November 23, 1973 requesting that your importation of copper tubes which you use in the manufacture of heat exchange coils and components for big industrial walk-in freezers or cold storage be subjected to the 7% advance sales tax with a 25% mark-up. In reply, I have the honor to inform you that this Office has consistently ruled that imported copper tubes are subject only to the 7% advance sales tax with a 25% mark-up. Such being the case, your aforesaid importation of copper tubes is subject to the 7% advance sales tax, the tax to be based on the landed cost thereof plus 25% mark-up pursuant to Section 183(b) in relation to Section 186, both of the Tax Code. aisa dc Very truly yours, EFREN I.
