Santos Bldg. 642 Raon St., Quiapo Manila S i r : In reply to your letter dated August 11, 1975 requesting that samples of phonograph records sent to you from time to time for audition purposes be subjected to the 7% compensating tax, I have the honor to inform you that imported phonograph record is subject to the 40% sales tax under Section 185(g) of the Tax Code. Consequently, the phonograph records sent to you from time to time for audition purposes and not for sale, barter or exchange are subject to the 40% compensating tax pursuant to Section 190 in relation to Section 185(g), both of the Tax Code. aisa dc Very truly yours, (SGD.)
