May 17, 1976 Mr. M.B. Quimson, Jr. Secretary-Treasurer Bulletin Publishing Corp. 1007 Romualdez St., Ermita Manila S i r : This refers to your letter dated March 1, 1976 requesting that your sales of the "Bulletin Today" and "Panorama" magazines to government bureaus, offices, agencies and its instrumentalities be exempted from the withholding provisions of R.A. No. 1051, as implemented by Revenue Regulations No. 21-67 (formerly Revenue Regulations No. V-40) cdt It is represented that Bulletin Publishing Corporation is in the publication business for the past seventy five (75) years; that it publishes the "Bulletin Today" & "Philippine Panorama" Magazines which appear at regular intervals with fixed prices for subscription and sale; and that said magazines are not devoted principally to the publication of advertisements. In reply, I have the honor to inform you that under the foregoing facts, the sale of your aforenamed publications is not subject to the 3% tax imposed by Section 191 of the Tax Code and consequently, the government offices subscribing to your aforesaid publications should not withhold from payments due you the 3% tax. acd Very truly yours, EFREN I.
