February 26, 1969 Mr. Rodolfo Paras 1447 Herran Street Paco, Manila S i r : This refers to your letter dated January 22, 1969, requesting opinion as to whether or not you are covered by the provisions of Republic Act No. 4917 exempting retirement benefits received by officials and employees of private firms from the payment of all taxes. In reply thereto, I have the honor to inform you that exemption from all taxes of retirement benefits under Republic Act No. 4917 refers to retirement benefits received from private firms in accordance with a reasonable private benefit plan maintained by the employer. This Office cannot definitely give an opinion as to whether or not you are covered by the provisions of Republic Act No. 4917 unless the plan maintained by your employer is submitted to this Office.
