BAYBAY CITY ORDINANCE NO. 007-18 ORDINANCE FIXING THE RENTAL RATE OF LINTA-ON PAVILION AND MAINTENANCE FEE FOR THE PUBLIC COMFORT ROOM LOCATED AT LINTA-ON PEAK, BAYBAY CITY, LEYTE (Sponsored by Honorable SP Member Atty. Ernesto M. Butawan, duly seconded by ALL SP Members) PREFATORY STATEMENT WHEREAS, the existence of Linta-on Peak is a pride of Baybay City considering that it draws multitudes of tourists of different nationalities all over the world; WHEREAS, the City Government has approved for the construction of LINTA-ON PAVILION to provide the influx of tourists comfortable shelter, recreation/entertainment; WHEREAS, for purposes of regulation, control and policy on the use of said Linta-on Pavilion by its guests, visitors and tourists, corresponding rates of rental fees has to be established. WHEREFORE, on motion of Honorable Atty. Ernesto M. Butawan and duly seconded by all members of this august body, be it; RESOLVED, as it hereby does RESOLVE, to enact an ordinance, in this chamber, on April 16, 2018, at Baybay City, Leyte. SECTION 1. Title . This Ordinance shall be known as "An Ordinance Fixing the Rental Rate of Linta-on Pavilion and Maintenance Fee for the Public Comfort Room located at Linta-on Peak, Baybay City, Leyte". SECTION 2. Declaration of Policy . It is the declared policy of the City Government of Baybay to construct the Linta-on Pavilion to provide safety and quality services for the pleasure of all the tourists nationwide coming to Linta-on Peak and establish regulation fees for its usage. SECTION 3. Tariff . 3.1 Hall Capacity : 200 persons With Aircon, first 4 hours - P4,000.00 Extension of stay - 500.00/hour Non-Aircon, first 4 hours - 3,000.00 Extension of stay - 300.00/hour 3.2 All Government - related functions less 10% 3.3 LGU-Baybay functions - Free of Charge 3.4 Use of Comfort Rooms - P5.00 Located outside the Pavilion SECTION 4. Payments . All rates, fees and charges shall be paid to the City Treasurer or duly authorized representatives. All collections shall be deposited in a trust fund for the operation and maintenance of the Pavilion. SECTION 5. Implementing Rules and Regulations . The City Tourism Office, as well as the Department Heads/Officers shall jointly formulate rules and regulations subject to the approval of the Sangguniang Panlungsod. SECTION 6. Separability Clause . The provisions of this Ordinance are hereby declared separable and if one or more provisions are held invalid, or unconstitutional, the remainder or any provision hereof not affected, shall remain valid and effective. SECTION 7. Repealing Clause . All ordinances, resolutions, rules and regulations inconsistent with or contrary to the provisions of this Ordinance are hereby repealed, amended or modified accordingly. SECTION 8. Effectivity. This Ordinance shall take effect 15 days upon its approval by the Sangguniang Panlalawigan and after due compliance with all the requirements provided for under R.A. 7160, otherwise known as the Local Government Code of 1991.
