Tropicales SB Member (OB) BALER ORDINANCE NO. 025-13 AN ORDINANCE AMENDING ARTICLE C, SECTION 5C.01 AND SECTION 5C.02 OF TAX ORDINANCE NO. 001-2012 Be it ordained by the Sangguniang Bayan of Baler, Aurora that: SECTION 1. Article C, Section 5C.01 and Section 5C.02 of Tax Ordinance No. 001-2012 are hereby amended to read as follows: ARTICLE C. Municipal Fish Port Fees and Charges are hereby modified to cover the supervision, control and regulations in the operation of Municipal Fish Port as economic enterprise and as tourist destination and other additional charges provided hereof. Section 5C.01. Definition of Terms . When used in this Article, the term: a. Berthing Fee The amount charged to any vessels of 3 gross tons or more that stays and/or berth in the area jurisdiction of the port. The fee is collected from the Boat Owner/Operator. This is on a per day basis at a rate depending on GRT of the vessel. b. Unloading Fee The fee collected from Fish Producers/Supplier who unloads fish at the fishport for auction or sale on a per tub, box or kilogram basis. c. Market Fee the fee collected from the fish brokers who trade fish at the market hall. d. Transshipment Fee the fee collected from the fish supplier transports fish outside the fishport and/or to the trader, viajero buying fish direct from fish producers to be transported outside the locality. This is also on a per tub, box or kilogram basis. e. Ice Conveyance Fee The fee collected from the ice supplier/dealer for the authority to sell ice inside the port which is not produced by PFDA. This is on a per block basis. aDSIHc f. Fuel Conveyance Fee the fee collected from the supplier for the authority to convey/sell fuel and oil inside the port. This is on a per liter basis. g. Entrance Fee the fee collected from the owner of vehicles entering and parking at the fishport. h. Wharfage Fee the amount charges to vessels for loading and/or unloading of cargoes other than fish at the port on a per tub, box/case, kilogram basis or percentage of declared value. i. Penalty Fee the amount charged to port who violates port rules and regulations set by PFDA on a per offense basis, and to lessee who violates provisions of the lease contract. j. Space Rentals the amount collected monthly from the port lessee who occupies space with the structure at the fishport on a per square meter basis. k. Store Rental the amount collected monthly from the port lessee who occupies the store at the fish port on per stall basis. l. Land Rental the amount collected monthly from the port lessee who occupies space without structure at the fish port on a per square basis. m. Market Hall Rental The amount collected from clients who utilized the market hall from special occasions like party, wedding, reunion and other related occasions and gatherings. n. Toilet Fee the fee collected from users of the comfort room. o. GRT Gross Register Tonnage. Section 5C.02. Imposition of Fees . Traders buying directly from producers and distributing outside the locality Ice Conveyance Fee 1.00/block Client who sell ice inside the port area Fuel Conveyance Fee 0.25/liter Client who sell fuel and oil inside the port area Entrance/Parking Fee - Heavy Vehicle 5.00/tire basis Owner of overland vehicle entering and parking at the port - Jeep and Pick Up 5.00/tire basis -do- - Tricycle/Motor 5.00/unit -do- - Tourist Coaster/Van 20.00 -do- Berthing Fee - Commercial Vessel 100.00/berth Owner of Vessel - Municipal Vessel 4D 50.00/berth -do- - Municipal Boat Straton 30.00/berth -do- Space Rental - Market Hall rental 300.00/day Client who use the market hall utilizing electricity - Stall rental 500.00/month Fishport lessee Wharfage Fee - Rice/Copra 1.00/sack Owner of vessel engaged on - Sweet Corn/Cassava 1.00/sack foreign or domestic trading - Cement 1.00/bag - Softdrinks 0.25/case - Beer & Hard Drinks 0.25/case - Scrap & Heavy 0.20/kg. Separability . The provisions of this Ordinance are separable, and in the event that any or more of such provisions are declared invalid, the validity of all other provisions shall not be affected thereby. ETHIDa SECTION 3. Repealing Clause . Any Ordinance, Executive Orders and Local Issuance or Rules and Regulations or part thereof, inconsistent with or in conflict with this Ordinance are hereby repealed and or altered accordingly.
