BAGUIO CITY TAX ORDINANCE NO. 01-12 PRESCRIBING RULES AND REGULATIONS GOVERNING THE OPERATION OF THE SLAUGHTERHOUSE, LIVESTOCK AND MEAT INSPECTION SERVICE IN THE CITY OF BAGUIO AND AMENDING SECTIONS 34 A TO G AND SECTION 35 OF TAX ORDINANCE NUMBERED 2000-001 On motion of Hon. Balajadia, seconded by Hon. Chan-Rondez, Hon. Yangot, Hon. Bagbagen and Hon. Aliping, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD (CITY COUNCIL) IN SESSION ASSEMBLED THAT: ARTICLE I Title of Ordinance SECTION 1. Title of Ordinance . This Ordinance shall be known as the "Slaughterhouse and Meat Inspection Code of the City of Baguio". ARTICLE II Definition of Terms SECTION 2. Definition of Terms . As used in this Ordinance, the following words, terms, and phrases are defined as follows: a. Carcass the body of any slaughtered animal after bleeding and dressing. b. Condemnation means the examination and judgment of meat or meat products according to approved protocols by a meat inspector/meat control officer/veterinarian as being unsafe or unsuitable for human consumption and requiring appropriate disposal. HEScID c. Confiscation the taking into custody of livestock, poultry, meat/carcasses, edible parts or parts from said carcasses or meat products by the meat inspector for its proper disposal for having been the subject of violation of the rules and regulations. d. Contamination direct or indirect transmission of any biological or chemical agent, foreign matter or other substances not intentionally added to food that may compromise food safety and suitability. e. Fit for human consumption meat that has passed inspection and appropriately branded by an inspector as safe and wholesome and in which no changes due to disease, decomposition or contamination have been subsequently found. f. Food any substance whether processed, semi-processed or raw intended for human consumption. g. Food animal all domestic animals slaughtered for human consumption such as cattle, carabaos, buffaloes, sheep, goats, hogs and poultry. h. Inspected and condemned a condition wherein the carcasses or parts of carcasses so marked have been inspected and found to be unsafe, unwholesome and unfit for human consumption. i. Inspected and passed a condition wherein the carcass or parts of carcasses so marked have been inspected and found to be safe, wholesome and fit for human consumption. j. Inspection an act by an official inspector to ensure compliance with rules and regulations including but not limited to humane handling of slaughter animals, ante and post mortem inspection, quality assurance program, hygiene and sanitation program, good manufacturing program, sanitation standard operating procedures, hazard analysis critical control point program, residue control program on any meat and meat product, meat establishment facilities, transport vehicle and conveyance. DEICaA k. Meat refers to the fresh, chilled or frozen edible carcass including offals derived from food animals. l. Meat Inspector a professionally qualified and properly trained officer duly appointed by the NMIS or the City Government of Baguio for meat inspection and control of hygiene under the supervision of a meat control officer/veterinarian. m. Meat product any product capable of use as human food which is made wholly or in part from any meat or other portion of the carcass of any food animals, excepting products which contain meat or other portions of such carcasses only in a relatively small proportion or historically have not been considered by consumers as products of the meat industry and which are exempted from definition as a meat product by the Secretary of Agriculture under such conditions as he may prescribe to assure that the meat or other portions of such carcasses contained in such product are not adulterated and that such products are not represented as meat products. n. Meat handler person directly involved in the preparation, transport and sale of meat and meat products. o. National Meat Inspection Service (NMIS) the sole national controlling/competent authority attached to the Department of Agriculture charged by the government with the control of meat hygiene and meat inspection. p. Safe and wholesome refers to meat and meat products that has been passed as fit for human consumption using the criteria that it: a. Will not cause food borne infection or intoxication when properly handled and prepared with respect to the intended use; ScaCEH b. Does not contain residue in excess of set limits; c. Is free of obvious contamination; d. Is free of defects that are generally recognized as objectionable to consumers; e. Has been produced under adequate hygiene control; and f. Has not been treated with illegal substances. q. Slaughterhouse or abattoir premises or establishment that are approved and registered by the National Meat Inspection Service (NMIS) in which food animals are slaughtered and dressed for human consumption. r. Unfit for human consumption means inspected and found not meeting the criteria of safety and wholesomeness. s. Cold storage refers to a type of meat establishment that is accredited by NMIS which is being used for the storage of local and imported meat and meat products; t. Frozen meat and meat products refers to meat and meat products subjected to freezing temperature below 18C. u. Meat establishment premises such as slaughterhouse, poultry dressing plant, meat processing plant, cold storage, warehouse and other meat outlets that are approved and registered by NMIS in which food animals, meat or meat products are slaughtered, prepared, processed, handled, packed or stored as applicable. ICTcDA v. Post-establishment control refers to monitoring and checking of meat and meat products during transport and sale in any meat outlet. It also means surveillance of persons/vehicle, casing of place involved in illegal processing or storage and measures to control proliferation of hot meat and meat products sold for human consumption. w. Primary packaging refers to first layer food grade wrapping materials in direct contact with the product to protect it from contamination. x. Thawing refers to defrosting of a frozen product either through exposure to higher temperature or by means of technology. y. "Botcha" means meat from carcass that was not bled well and/or from dead animal (double dead). It could also be meat from carcass that was butchered after more than 36 hours without refrigeration or stored in temperature higher than 10C and under stage of decomposition. ARTICLE III Slaughterhouse Operation SECTION 3. All food animals such as cattle, carabao, swine, sheep and goat intended for human consumption and for sale shall all be slaughtered in the city slaughterhouse. TECIaH SECTION 4. Slaughterhouse schedule of operations shall be set by the City Veterinarian and may be amended from time to time as deemed necessary. The slaughterhouse compound shall be fenced and closed and shall only be opened during slaughterhouse operation. SECTION 5. Entry into the Slaughterhouse . Only the following are allowed to enter the slaughterhouse compound: a. Authorized persons and visitors; b. Duly registered and accredited dealers, traders, butchers, utility or delivery personnel and meat handlers; c. Duly accredited delivery vehicles; and d. Animals to be slaughtered upon presentation of required documents such as valid health certificates and shipping permits. SECTION 6. Slaughtering Procedures . The following slaughtering procedures should always be observed: a. Entry of animals will only be through designated entry points; b. All animals must be properly bathed before stunning; c. Stunning, scalding, dehairing, evisceration and washing of offals shall be done only at designated areas; d. Scalding vat is for scalding purposes only. Dehairing within the scalding vat is prohibited; HASDcC e. Dehairing and evisceration should either be at the dehairing table or overhead rails. Carcass and offal must never touch the floor; f. Red/black offal should be separated from white offal upon evisceration prior to clearing of all its contents; g. Distended urinary bladders must be excised carefully and not incised to prevent contamination; h. Cleaned entrails and hides must be placed immediately in hard plastic containers; i. Hooves must be removed before delivery. j. Unauthorized removal and or trimming of any part of the carcass or entrails are prohibited; and k. Cleanliness and sanitation of the slaughterhouse, premises and facilities shall always be maintained. SECTION 7. Meat Hauling and Delivery. Private meat delivery vehicles may be allowed to haul and deliver meat/carcasses from the city slaughterhouse to the market with the following conditions: a. Only accredited meat delivery vehicles with valid business permit will be allowed to load, deliver and transport meat/carcasses and offals; b. Floors of delivery vehicles must be with hard plastic matting; c. Carabao/cattle carcass shall not be mixed with hog carcass during transport or delivery and in no time shall carcasses be stepped upon; TIHDAa d. No offal shall be allowed transport or delivery unless contained in a leak proof hard plastic; and e. Handlers or delivery personnel must be clean and with proper attire/uniform as prescribed by the City Veterinarian. SECTION 8. Personal Hygiene and Requirements for Personnel Working in the Slaughterhouse and Meat Handlers . All butchers and/or meat handlers shall: a. Secure health certificate issued by the City Health Officer and meat handlers' license issued by the City Veterinarian which shall be renewed every year; b. Undergo four (4) hours orientation to be conducted by the City Veterinary Office; c. Wear proper attire and uniform as prescribed by the City Veterinarian; d. All persons entering the slaughtering area must be in clean clothes and white rubber boots; e. Not sport beard and/or mustache, must sport short hair and regularly trimmed fingernails; and f. Not wear sleeveless, shorts, shoes and slippers. TcHCIS SECTION 9. Cleaning and Disinfection . Cleanliness and sanitation of the slaughterhouse, corrals, and premises shall always be maintained. The following shall be implemented: a. Foot baths shall be in place in all entry points of the slaughterhouse and corrals; b. Wheel baths shall be in place in all entry points of vehicles; c. Liquid wastes shall be connected to the city sewer line; d. Solid wastes shall be composted in the slaughterhouse compound if possible or hauled to the city dumpsite/sanitary landfill or to farms/gardens within the BLISTT (Baguio, La Trinidad, Itogon, Sablan, Tuba, Tublay) area when requested; and e. Regular cleaning and disinfection shall be conducted. SECTION 10. Fees and Charges . There is hereby levied fees and charges: a. Slaughter, Corral and Inspection Fee Cattle/carabao P200.00 per head Swine P100.00 per head Goats/sheep P100.00 per head b. Meat Handlers license fee P100.00 per license c. Meat Conveyance Accreditation Fee P500.00 per vehicle Slaughter, corral and inspection fees shall be paid upon slaughter of animal or before carcasses are brought out of the slaughterhouse. CASIEa d. Goat Corral Fee P500.00 per sq. meter/month e. Swine Corral Fee (livestock market) P250.00 per sq. meter/month Goat and swine corral fee (livestock market) shall be paid on a monthly basis and shall be paid on or before the last working day of the month. Slaughter, corral and inspection fees shall be paid before meat/carcasses are brought out from the slaughterhouse. SECTION 11. Livestock Market. The livestock market in the slaughterhouse compound being utilized to sell live animals such as pigs and goats shall remain in the slaughterhouse compound until such time that the city shall designate a new area for the purpose. SECTION 12. Use of Holding Pen . The animals to be slaughtered shall be corralled at the designated pen/corral per livestock dealer with the following provisions: a. Holding Pens shall be assigned by the City Veterinarian. Leasing of corrals is prohibited; b. Holding pens, if not in use, should be surrendered to the City Veterinarian and City Treasurer in writing; and c. Cleanliness and sanitation should always be maintained. SECTION 13. The sale of livestock in the slaughterhouse compound shall follow all rules and regulations as prescribed by the City Veterinarian pursuant to city ordinances, national laws, rules and regulations promulgated by the Department of Agriculture and other authorities. DTIaHE SECTION 14. Other Prohibited Acts. a. Slaughtering of animals other than in designated areas; b. Smoking, urinating, spitting, blowing of nose and eating inside the slaughterhouse; c. Intoxication and/or drinking of alcoholic drinks within the slaughterhouse compound; d. Loitering/standing by inside the slaughterhouse and/or premises; e. Bringing out of carcass prior to inspection; and f. Nonpayment of fees. SECTION 15. Authority of the City Veterinarian . The City Veterinarian being the administrator and caretaker of the slaughterhouse compound is hereby authorized to promulgate and implement additional rules and regulations not covered by this Ordinance in the operation of the city slaughterhouse as deemed necessary. SECTION 16. Parking of Vehicles . Parking of vehicles in the slaughterhouse shall be allowed only for the following: a. Vehicles of City Veterinary Office and employees of the same shall be parked in designated areas; b. Livestock and carcass delivery vehicles during loading and unloading time only. Parking of the same is not allowed; AHacIS c. Livestock buyers and dealers' vehicles during loading and unloading of animals only. Parking of the same is not allowed; and d. Clients of the office in designated areas and for the duration of the transaction. ARTICLE IV Meat Inspection A. ANTE MORTEM INSPECTION SECTION 17. Ante-Mortem Inspection . An ante-mortem inspection shall be made of all food animals by authorized inspectors before it shall be allowed for slaughter in which the meat or meat products thereof are to be sold. SECTION 18. Ante-mortem inspection shall be carried out in a systematic manner in accordance with routine inspection procedures prescribed by NMIS pursuant to the Meat Inspection Code of the Philippines (Republic Act No. 9296) and shall ensure that animals found to be affected by a disease or defect that would render their meat unfit for human consumption are so identified and removed from the food chain. B. POST-MORTEM INSPECTION SECTION 19. Post-mortem inspection and examination of carcasses and parts thereof of all food animals for sale shall be conducted. SECTION 20. Post-mortem inspection of the carcasses and parts thereof shall be carried out in a systematic manner in accordance with the procedures prescribed by the NMIS pursuant to the Meat Inspection Code of the Philippines (Republic Act No. 9296) thus ensuring that meat passed for human consumption is safe and wholesome. AEDcIH SECTION 21. Proper Marking of Carcasses . The carcasses and parts thereof of all such animals found clean, safe and fit for human consumption shall be marked, stamped, tagged or labeled as "INSPECTED AND PASSED". All carcasses and parts thereof found to be unfit for human consumption shall be marked "INSPECTED AND CONDEMNED". C. POST-MEAT ESTABLISHMENT CONTROL SECTION 22. Post-Meat Establishment Control. Inspection of meat and poultry including its by-products shall be conducted in the market, meat outlets including groceries, supermarkets or establishments where meat, poultry and by-products are sold and shall be carried out in a manner as prescribed by the NMIS pursuant to the Meat Inspection Code of the Philippines (Republic Act No. 9296) and Department of Agriculture Administrative Order No. 22, series of 2010. SECTION 23. Meat, Poultry and By-products from Animals Slaughtered Outside Baguio City. Meat, poultry and by-products from animals slaughtered outside Baguio City are allowed to be sold in the city provided they are inspected by the city meat inspectors and found to be fit for human consumption and provided these are accompanied by a valid meat inspection certificates and slaughtered in "AA" and "AAA" NMIS-accredited slaughterhouse, dressing plant and processing plant. SECTION 24. Imported Meat and Poultry Products . Imported meat and poultry products are allowed to be sold in the City provided they are inspected by the city meat inspectors and found to be safe and fit for human consumption with accompanying Certificate of Meat Inspection (COMI) of imported meat. Products shall comply with all the requirements of the Consumer Act of the Philippines (Republic Act No. 7394)and Department of Agriculture Administrative Order No. 22, series of 2010. DacASC SECTION 25. Rules and Regulations in the Handling of Frozen and Chilled Meat and Meat Products in the Meat Markets . The following rules and regulations shall be strictly observed in the handling of frozen meat and meat products intended for sale in the meat markets. 1. All persons and entities engaged in the handling and sale of frozen meat and meat products in the meat markets shall be accredited/licensed by NMIS or registered with the City Government. 2. Frozen meat and meat products shall be displayed and sold in the meat stalls in sealed primary packaging. 3. Thawing and repacking from bulk packaging shall be done in an NMIS accredited meat establishment and under temperature controlled environment of 10C. The Meat Inspector, Meat Control Officer shall inspect and certify as to product fitness for human consumption. 4. Retail packaging material shall ensure traceability and bear the identity of the original source such as name, address, and accreditation number as well as that of the NMIS licensed repacker. 5. The retail packages shall be stored in refrigerated facilities and transported in vehicles that are able to maintain temperature not higher than 4C. In the meat stall, the retail-packed frozen meat and meat products shall be kept in sanitary refrigerated containers made of stainless steel or food grade plastic. It shall be kept in temperature not higher than 10C. 6. All frozen meat and meat products offered for sale in the meat market shall be accompanied by meat and meat product inspection certificate. IDSaAH SECTION 26. Transporting, distributing and/or selling of "botcha" (double dead meat) is strictly prohibited. ARTICLE V Transport of Meat, Poultry and Products SECTION 27. Mode of Transport. All vehicles used for the transport of meat, poultry and by-products shall conform with the standards prescribed by the NMIS. Vehicles used for the transport of meat, poultry and by-products within Baguio City shall be accredited by the City Veterinarian. Vehicles used to transport meat, poultry and by-products from other areas to the city shall be accredited by the NMIS. SECTION 28. Meat Delivery Fee . The following fees are hereby imposed for the delivery and/or transport of carcasses of hogs, large cattle, etc. from the city abattoir to the city market: Large cattle (cows, carabaos, horses) P15.00/head Hogs P10.00/head Goats P5.00/head Chicken P3.00/head All others P3.00/head ARTICLE VI Confiscation and Disposal of Meat, Poultry and By-Products SECTION 29. Confiscation . Any carcass, parts of carcasses or products of carcasses found to have been prepared, handled, packed, stored, transported or offered for sale as human food not in accordance with any provisions of this Ordinance shall be confiscated pursuant to the Meat Inspection Code of the Philippines (Republic Act No. 9296). DCcTHa SECTION 30. Disposal of Confiscated Meat, Poultry and By-Products . All confiscated meat, poultry and by-products found to be safe and fit for human consumption as determined by the meat inspector shall be donated to the City Social Welfare and Development Office or any charitable nongovernmental organizations while those found to be adulterated and unfit for human consumption as determined by the meat inspectors shall be disposed of by burying. SECTION 31. All expenses incurred in the proper disposal of confiscated/imported items shall be borne by the importer/owner or any other party found to be involved in its importation, sale and or distribution. ARTICLE VII Offenses and Penalties SECTION 32. The following are the offenses and penalties in this Ordinance: a. Any person found to have violated any provision of Article III of this Ordinance shall be meted penalty of: 1) first offense suspension of meat handlers license for one (1) week and a fine of P500.00; and 2) second offense cancellation/revocation of meat handlers license and a fine of P1,000.00. AEIDTc b. Any person found to have violated any provision of Article IV to Article V of this Ordinance shall be penalized with a fine of P5,000.00 and confiscation of animal, meat/carcasses. c. Violation of Section 10 shall be reported to the Traffic Division of the Baguio City Police Office for proper and appropriate action. d. Any person defying, harassing, obstructing enforcers in implementing any provision of this Code shall be penalized with a fine of P5,000.00 and shall be banned to enter the slaughterhouse compound for thirty (30) days. e. Any person found to have violated Section 26, Article IV, shall be penalized by confiscation, fine of not more than P5,000.00 and imprisonment of not less than one (1) year. SECTION 33. Separability Clause . If, for any reason or reasons, any part or provision of this Ordinance shall be held to be unconstitutional or invalid, the other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect. SECTION 34. Repealing Clause . All ordinances, resolutions and regulations or part or parts thereof which are inconsistent with this Ordinance are hereby repealed and/or modified accordingly. SECTION 35. Effectivity Clause . This Ordinance shall take effect in accordance with the provisions of the Local Government Code of 1991. Unanimously adopted. ITADaE CERTIFIED CORRECT: (SGD.)
