June 29, 2009 BAGUIO CITY ORDINANCE NO. 61-09 THE REVISED TOURISM CODE OF BAGUIO CITY Introduced by Hon. Perlita L. Chan-Rondez, Hon. Erdolfo V. Balajadia and Hon. Antonio R. Tabora Jr. Explanatory Note Section 17 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that aside from the regular powers and duties vested in local government units, they shall likewise discharge the functions and responsibilities of national agencies and offices devolved to them pertaining to basic services and facilities. Such basic services and facilities include among others, the regulatory powers of the Department of Tourism, the City Government of Baguio and the Baguio Tourism Council over the operation and maintenance of all tourism-oriented and tourism-related establishments such as cafs, restaurants, beer houses, hotels, inns, pension houses, lodging houses, and other similar establishments, including tourist guides and transports [Section 458 (4) (iv), Local Government Code of 1991.] To ensure the efficient and effective operation and maintenance of all tourism-oriented and tourism-related establishments, it is imperative to provide such rules and regulations as may be necessary for their governance: NOW THEREFORE on motion of Hon. Chan-Rondez, Hon. Tabora and Hon. Cario, seconded by Hon. Tabanda, Hon. Aliping and Hon. Bagbagen, BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD (CITY COUNCIL) IN SESSION ASSEMBLED THAT: PART ONE Basic Provisions ARTICLE I SECTION 1. Title . This Ordinance shall be known as the Revised Tourism Code of Baguio City . SECTION 2. Scope. This Ordinance shall govern and regulate tourism development and promotion programs and within the City of Baguio, including the licensing, registration, regulation and supervision of the operations of tourism-oriented/related establishments. SECTION 3. Application . This Ordinance shall apply to all private and government owned and controlled entities [such as resorts, hotels, lodging facilities, travel agencies, tourist guides, transport groups and organizations] that are tourism-oriented/related, and other similar establishments whether their operation is domestic or international in scope. SECTION 4. Construction . This Ordinance shall be liberally construed in order to promote its objectives. CAIHTE ARTICLE II SECTION 5. Legal Authority . Legal authority for the implementation of the Revised Tourism Code is vested upon the following with specifically designated functions, to wit: (a) Republic Act No. 7160, the Local Government Code of 1991 . The Local Government Code states in its General Provisions that the city administers all tourism facilities and other tourist attractions including the acquisition of equipment, regulation and supervision of business concessions, and security services for such facilities and is responsible for tourism development and promotion of programs. (b) The Office of the City Mayor . The City Mayor is the chief executive and chief operating officer of all tourism programs of the City of Baguio. He designates chairperson/s of all institutionalized tourism programs which are observed and celebrated yearly or regularly in the city. He guides the Tourism Officer as regards all tourism-related activities and projects. (c) The City Tourism Office . The City Tourism Office works with the Office of the City Mayor when it concerns tourism. (d) The City Tourism Officer . The City Tourism Officer, as a regular employee of the City Government, performs all functions and responsibilities related to tourism. He coordinates with different offices as regards the implementation of tourism projects and programs of the City of Baguio. (e) The Sangguniang Panlungsod (City Council) Committee on Tourism, Special Events, Parks and Playgrounds . The Sangguniang Panlungsod (City Council) Committee on Tourism, Special Events, Parks and Playgrounds is a major committee in the City Council composed of three (3) City Councilors whose function is to provide legislative aid in terms of resolutions or ordinances to support tourism programs and projects of the City of Baguio. Approved and proposed resolutions and/or ordinances, which provide for the creation or upgrading of the Tourism Office of the City Government of Baguio, shall form part of this Code upon recommendation of the Baguio Tourism Council in accordance with Civil Service laws. (f) The Department of Tourism-Cordillera Administrative Region (DOT-CAR) The Department of Tourism-Cordillera Administrative Region (DOT-CAR) assists the City of Baguio in the implementation of rules and regulations to govern the accreditation of hotels, tourist inns, motels, apartels, resorts, pension houses and other accommodation establishments. (g) The Baguio Tourism Council The Baguio Tourism Council is an independent incorporated foundation, non-stock, non-political and non-sectarian, composed of unlimited members. Its main purpose, function and objective is to be the policy recommending body that is tasked for the promotion, development and maintenance of tourism in the City of Baguio and its environs. (h) Such other agencies may be authorized by the City Council or the local chief executive to assist in the implementation of the Revised Tourism Code. ARTICLE III SECTION 6. Definitions and Acronyms. For purposes of this Ordinance, the terms and phrases enumerated in this Section shall be construed or interpreted to mean or refer to, as follows: DETACa (1) Definitions (a) Apartment-Hotel (APARTEL) . An Apartment-Hotel is a type of accommodation described as "a serviced apartment complex that uses a hotel style booking system". It is similar to renting an apartment, but with no fixed contracts and occupants can 'check out' whenever the wish. Apartment-Hotels are flexible types of accommodation; instead of the rigid format of a hotel room, an apartment-hotel complex usually offers a complete fully fitted apartment. These complexes are usually custom built, and similar to a hotel complex containing a varied amount of apartments. (b) Association . An organization of persons/entities having the subject of tourism as a common interest. (c) Bars, Cocktail Lounges, Beer Houses, Gardens, Night or Day Clubs, Super Clubs . Establishments that serve drinks, especially alcoholic beverages such as beer, liquor, and mixed drinks, for consumption on the premises. Bars provide stools or chairs for the patrons along tables or raised counters. Some bars have entertainment on a stage, such as singers, dancers, comedians and other performers. Bars that are part of hotels are sometimes called long bars or hotel lounges . c.i. Hotel Bar, Resort and Restaurant Bar is an outlet or an amenity of a hotel or resort establishment serving food and beverages within its premises. c.ii. Cocktail lounge A bar room in a hotel or restaurant where cocktails are served. c.iii. Beer garden is an open-air area where beverages and prepared food are served. It is usually attached to a drinking establishment such as a public house. c.iv. Nightclub is a drinking, dancing, and entertainment venue which does its primary business after dark. A nightclub is usually distinguished from bars, pubs or taverns by the inclusion of a dance floor and a DJ booth where a DJ plays recorded dance and pop music played over a powerful PA system. Some nightclubs have other forms of entertainment, such as comedians, "a-go-go" dancers, a floor show, or strippers. c.v. Super club includes any establishment where food and drinks are served to its patrons to the accompaniment of music furnished by such establishment with musicians under its employ or by jukeboxes or record players installed within its premises, and where patrons are allowed to dance only with partners who they bring along. (d) Campsite . It is a place used for overnight stay in the out of doors. A campsite consists typically of open pieces of ground where a camper can pitch a tent or park a camper. More specifically a campsite is a dedicated area set aside for camping and for which often a user fee is charged. The term 'campsite' usually means an area where an individual, family, group or military unit might camp. (e) Carinderia . Small food outlet serving low budget ready-to-eat meals. (f) Catering Services . Its main purpose is to provide foods and services. 1. On-Premise in which food is prepared, cooked and served at the same venue. 2. Off-Premise where food is prepared and cooked in a workstation preferred by the caterer but served somewhere else. aDSIHc (g) Condominium-Hotel (CONDOTEL) . It is an establishment operated as a hotel with a registration desk, cleaning service and more. The units are individually owned. Unit owners also have the option to place their unit in the hotels rental program where it is rented out like any other hotel room. (h) Department Store . A store which sells or carries several lines of merchandise in separate sections including one devoted to Filipiniana items. (i) Dormitory . It typically refers to residence halls, which are sleeping quarters or entire buildings primarily providing sleeping and residential quarters for large number of people, often boarding school, college or university students. (j) Fast Food . Specific type of restaurant characterized both by its fast food cuisine and by minimal table service. Food served in fast food restaurants typically caters to a "meat-sweet diet" and is offered from a limited menu; is cooked in bulk in advance and kept hot; is finished and packaged to order; and is usually available ready to take away, though seating may be provided. Fast food restaurants are usually part of a restaurant chain or franchise operation, which provisions standardized ingredients and/or partially prepared foods and supplies to each restaurant through controlled supply channels. (k) Guest/Visitor/Tourist . One "who is not a resident of Baguio" who comes to see a person or spends some time in a place, whether for social, business, or professional reasons, or for pleasure usually registered as a paying occupant in an accommodation facility or as nonpaying occupant in a residence not his/her own. A visitor is not a resident of the city who comes to see a person or spends some time in a place. (l) Homestay . It is a form of tourism and/or study abroad program that allows the visitor to rent a room from a local family to better learn the customs and tradition. Hosting a homestay participant also allows the local family to earn some additional, needed income. This was formerly called transient home . (m) Hotel . An establishment that provides paid lodging on a short-term basis. The provision of basic accommodation, with modern facilities including en-suite bathrooms, a telephone, an alarm clock, a television, and internet connectivity; snack foods and drinks may be supplied in a mini-bar, and facilities for making hot drinks. Larger hotels may provide a number of additional guest facilities such as a restaurant, a swimming pool or childcare, and have conference and social function services. (n) Inbound Tour . A tour of the Philippines or any place within the Philippines. (o) License . The privilege or authority granted by the BPLO to own, operate, manage and maintain a tourist establishment. (p) Motel . Refers initially to a type of hotel consisting of a single building of connected rooms whose doors face a parking lot and, in some circumstances, a common area; or a series of small cabins with common parking. An establishment that provides lodging for motorists in rooms usually having direct access to an open parking area. Also called motor court , motor lodge . (q) Outbound Tour . A tour to or any other place outside of the Philippines. ETHIDa (r) Pension House/Lodging House . A private or family-oriented tourist boarding house or tourist lodging house, employing non-professional domestic helpers, regularly catering to tourists and/or travelers, containing several independent lettable rooms, providing common facilities such as toilets, bathrooms/showers, living and dining rooms and/or kitchen and where a combination of board and lodging may be provided. A minimum of five (5) rooms is required to qualify as a pension house. (s) Registration . The listing of tourism-oriented and tourism-related establishments, including those offering training and promotion programs, after such establishments and facilities shall have been certified by the Baguio City Government as having conformed to the minimum standards and requirements in accordance with this Ordinance. (t) Resort . Any place or places with pleasant environment and atmosphere conducive to comfort, healthful relaxation and rest, offering food, sleeping accommodation and recreational facilities to the public for a fee or remuneration. (u) Resort and Recreational Facilities . Including swimming pools, bowling lanes, tennis courts, pelota or squash courts, golf course, riding range, archery range and similar facilities forming part of the resort. (v) Restaurant . It is an establishment that prepares and serves food and drink to customers. Meals are generally served and eaten on premises, but many restaurants also offer take-out and food delivery services. Restaurants vary greatly in appearance and offerings, including a wide variety of cuisines and service models. Restaurants may include wait staff; others provide counter service; and some are buffet style. (w) Retreat Houses . Establishments providing food and lodging to devotees whose such services are on the basis of religious activities. (x) Special Interest Resort . Refers to resorts located at appropriate mountain forest, lake or river sites, providing facilities and equipment for the conduct of special interest activities, wildlife observation and bird watching, cave exploration, backpacking, hiking, camping, trail riding (either motorized or horseback), tribal visits and safaris, target shooting and hunting theme parks. (y) Souvenir Shop . A small retail establishment specializing in Filipiniana and souvenir products. (z) Tour Guide . An individual who is a bona fide member of a duly registered tour guide association or duly licensed travel agency accredited by the City Government of Baguio or the DOT. He or she is a member of a duly licensed travel agency and/or tour operator who guides/lectures foreign or domestic tourists on sights seen and places visited, looks after their well being, and serves to ensure the on-time delivery of confirmed services in a package tour on behalf of the travel agent/tour operator/consultant, for a fee, commission or any form of monetary consideration. (aa) Tour Managers . They lead groups as part of a package holiday. They act as interpreters for the group and as representatives of the holiday company. Importance is placed on the guides' knowledge of language, travel documentation requirements and cultural differences. (bb) Tour Operator . A tour operator typically combines tour and travel components to create a holiday. The most common example of a tour operator's product would be a flight on a charter airline plus a transfer from the airport to a hotel and the services of a local representative, all for one price. (cc) Tourism Training Program . Any training program that caters to or is involved in the tourism industry. (dd) Tourism-Oriented Establishment . Any establishment which is registered and licensed by the appropriate offices of the City Government which caters directly to tourists, whether domestic or foreign. cSEDTC (ee) Tourism-Related Establishment . Any establishment or enterprise which may or may not be registered with the BTC but which caters incidentally to both foreign and local travelers and tourists. (ff) Tourist Frontliners . An individual who has undertaken basic tour guiding or reception training conducted by the DOT, the City Government of Baguio and the Baguio Tourism Council. The requirement to become tourist frontliners is a certification of attendance of training. (gg) Tourist Inn . A lodging establishment catering to local and foreign tourists not meeting the minimum requirements of an economy hotel. (hh) Tourist Land Transport Unit . Any vehicle carriage or conveyance moving on wheels used on public roads or tunnels and highways and catering to tourists. (ii) Tourist Transport Operator . A person or entity which may either be a single proprietorship partnership or corporation, regularly engaged in providing, for a fee or lawful consideration, tourist transport services as hereinafter defined, either on charter or regular run. (jj) Air Transport Operator . Any air conveyance catering to tourists. (kk) Travel Agency . A business that attends to the details of transportation, itinerary, and accommodations for travelers. It is a retail business that sells travel related products and services to customers, on behalf of suppliers, such as airlines, car rentals, cruise lines, hotels, railways, sightseeing tours and package holidays that combine several products. In addition to dealing with ordinary tourists, most travel agencies have a separate department devoted to making travel arrangements for business travelers and some travel agencies specialize in commercial and business travel only. There are also travel agencies that serve as general sales agents for foreign travel companies, allowing them to have offices in countries other than where their headquarters are located. (ll) Travel and Tours Consultant . An entity which may either be a single proprietorship, or corporation regularly engaged in the business of extending to individuals or groups, information on travel and/or tour packaging requirements, within or outside the Philippines, and/or make arrangements for travel and tours requirements as an agent of the different tourism components whether or not for a fee, commission or any form of compensation. (2) Acronyms (a) BID The Bureau of Immigration and Deportation. (b) BOI The Board of Investments. (c) BPLO The Business Permits and Licensing Office. (d) BTC The Baguio Tourism Council. (e) CAD The Office of the City Administrator. (f) CITY The City Government of Baguio. (g) DENR The Department of Environment and Natural Resources. SDAaTC (h) DFA The Department of Foreign Affairs. (i) DOT The Department of Tourism. (j) LTFRB The Land Transportation Franchising and Regulatory Board. (k) LTO The Land Transportation Office. (l) PTA The Philippine Tourism Authority. ARTICLE IV SECTION 7. Administrative and Technical Setup for Implementation . For purposes of implementation of the provisions of this Ordinance the BPLO and the Baguio Tourism Council shall perform technical and administrative duties and functions. The City Council Committee on Tourism Special Events, Parks and Playgrounds shall perform oversight functions. PART TWO Standard Requirements for the Operation/Maintenance of Tourism Establishment, Etc . ARTICLE V Classification of Resorts SECTION 8. Kinds of Resorts . Resorts may be categorized as inland resort (located within the town proper or city), lakeside or riverside resort (located along or near the back of a lake or river), and mountain resort (located at or near a mountain or hill), and theme parks. SECTION 9. Classes of Resorts . For purposes of registration and licensing, resorts shall be classified as follows: Class " AAA " Class " AA " Class " A " Special Interest Resort. SECTION 10. Requirements for "AAA" Class Resort . The following are the minimum requirements for the operation and maintenance of an " AAA " Class Resort: (a) Location and Environment The resort shall be located in a suitable location free of noise and atmospheric pollution. (b) Parking An adequate parking space with parking security shall be provided free to guests. (c) Facilities and Room Accommodation The resort shall have its rooms, facilities and amenities equivalent to those of a First Class Hotel. (d) Public Washrooms There shall be first class and adequate public toilets and bathrooms for male and female provided with sufficient hot and cold running water, toilet paper, soap, hand towel and/or hand drier. (e) Sports and Recreational Facilities The resort shall have at least four (4) recreational facilities. (f) Conference/Convention Facilities Conference/convention facilities with attached toilets shall be provided. (g) Employees Facilities The management of the resort shall provide uniforms of employees. The frontline employees should wear uniforms with a Cordillera motif. Adequate and well-maintained locker rooms and bathrooms for male and female employees, including cafeteria, shall be provided. SECTION 11. Minimum Requirements for "AA" Class Resort . The following are the minimum requirements for the operation and maintenance of " AA " Class Resort: (a) Parking An adequate parking space with parking security shall be provided free to guests. (b) Facilities and Accommodations The resort shall have its rooms, facilities and amenities equivalent to those of a Standard Class Hotel. acEHCD (c) Public Washrooms There shall be clean and adequate public toilets and bathrooms for male and female, provided sufficient running water, toilet paper, soap, hand towel and/or drier. (d) Sports and Recreational Facilities The resort shall offer at least three (3) sports and recreational facilities. (e) Conference/Convention Facilities Conference/convention facilities shall be provided. (f) Employees Facilities The management of the resort shall provide uniforms of employees. The frontline employees should wear uniforms with a Cordillera motif. Adequate and well-maintained locker rooms and bathrooms for male and female employees shall be provided. SECTION 12. Minimum Requirements for "A" Class Resort . The following are the minimum requirements or the operation and maintenance of " A " Class Resort: (a) Parking An adequate parking space with parking security shall be provided free to guests. (b) Facilities and Accommodations The resort shall have its rooms, facilities and amenities equivalent to those of an Economy Hotel. (c) Room Accommodations Class "A" resort shall have its rooms equivalent to those of an Economy Hotel as required under this Ordinance. (d) Public Washrooms There shall be clean and adequate public toilets and bathrooms for male and female provided with sufficient running water, toilet paper and soap. (e) Sports and Recreational Facilities The resort shall offer at least two (2) sports and recreational facilities. (f) Food and Beverage Outlets The resort shall have one (1) food and beverage outlet. SECTION 13. Minimum Requirements for a Special Interest Resort . For purposes of registration and licensing, the following are the basic requirements for the establishment, operation, and maintenance of special interest resort: (a) Location The camp and ground sites shall be well-drained and is not subject to flooding. It shall be distant from any source of nuisance and shall not endanger sources of any water supply and other natural resources. (b) Lounge and Reception Counter There shall be a reception counter and a reasonably furnished lounge commensurate with the size of the resort. (c) Room Accommodation There shall be at least five (5) lettable bedrooms for permanent site operations. The bedroom shall be reasonably spacious and provided with comfortable bed(s), as well as sufficient and fresh supply of clean linen and mirror. For movable operation, a minimum of sixteen (16) guests plus the staff shall be accommodated in tents, lean-tos, and the like. Where permanent tents are used, flooring shall be at least four (4) inches above the ground. Tents shall be provided with adequate bedding suitable for tropical use. Theme parks may be exempted from these requirements. (d) Toilet and Bathroom Facilities There shall be separate clean toilet and bathroom facilities for male and female guests which shall be provided with sufficient supply of running water and situated in appropriate and accessible areas. The same shall be supplied with soap and toilet paper. Adequate portable chemical toilets shall be provided at the campsite for mobile groups. In the absence of chemical toilets, temporary sanitary latrines shall be provided based on acceptable Philippine standards. (e) Lighting, Furnishing and Ventilation Lighting arrangements and furnishing in all rooms shall be of good standard. In cases where there is no electrical power, each room shall be provided with non-hazardous portable light. Adequate means of ventilation shall be provided in accordance with the Building Code for all categories. (f) Staff and Service Adequate number of trained, experienced, courteous, and efficient staff shall be employed. They shall wear clean uniforms at all times. The frontline staff shall have a good speaking knowledge of English. SDHTEC ARTICLE VI General Rules on the Operation and Management of Resorts SECTION 14. Maintenance and Housekeeping . Maintenance of all sections of the resort shall be of acceptable standard, and all shall be on continuing basis, taking into consideration the quality of materials used as well as its upkeep. Housekeeping shall be of such a standard ensuring well-kept, clean and pollution-free premises. A vermin control program shall be regularly maintained in all areas of the resort. Regular and hygienic garbage disposal system shall be maintained. Sanitation measures shall be adopted in accordance with the standards prescribed under Presidential Decree No. 856, the Sanitation Code of the Philippines. SECTION 15. Lifeguard and Security . All resorts shall provide the services of a sufficient number of well-trained lifeguards duly accredited by either the Philippine National Red Cross, the Water Life Saving Association of the Philippines or any recognized organization training or prompting safety objectives, and adequate security whenever there are guests. SECTION 16. Medical Services . All resorts shall provide the services of a physician, either on-call or on full-time basis, depending on its volume of operation and accessibility to hospital or medical centers. In addition, resorts shall employ adequate first-aiders who have completed a course in first aid duly certified by the National Red Cross or any other organization accredited by the same. Adequate first aid medicines and necessary life-saving equipment shall be provided within the premises. SECTION 17. Fire-Fighting Facilities . Fire-fighting facilities shall be provided in accordance with the Fire Code of the Philippines. SECTION 18. Emergency Equipment/Facilities . Must be provided in accordance with the Fire Code of the Philippines. SECTION 19. Signboards/Signages . All signboards/signages to be installed must be in accordance with the Building Code of the Philippines and all existing city ordinances. SECTION 20. Precautionary Measures . (a) Night swimming at the pools shall be allowed only if there are adequate lifeguards on duty and when the pool premises are sufficiently lighted. (b) Management shall post sufficient and visible signs in strategic areas in the swimming pools to warn guess/customers of the presence of artificial or natural hazards, danger areas or occurrences thereat. (c) Resort keepers, managers or operators shall likewise prohibit gambling of any form drunkenness or disorderly conduct of any kind, or allow any activity using prohibited drugs in the resort and immediate premises. ARTICLE VII Classification of Hotels SECTION 21. Classification of Hotels . For purposes of registration and licensing, hotels are hereby classified into the following categories, namely: (a) De Luxe Class/five star (b) First Class/four star (c) Standard Class/three star (d) Economy Class/one-two star. ARTICLE VIII Standards of Each Class of Hotel SECTION 22. Requirements for a De Luxe Class Hotel . The following are the minimum requirements for the establishment, operation and maintenance of a De Luxe Class Hotel: AScHCD (a) Location 1. The locality and environs including approaches should be suitable for a luxury hotel of international standard. 2. The faade, architectural features and general construction of the building shall have the distinctive qualities of a luxury hotel. (b) Bedroom Facilities and Furnishings Size All single and double rooms shall have a floor area of not less than twenty-five (25) square meters, inclusive of bathrooms. Suite There shall be one (1) suite per thirty (30) guest rooms. Bathrooms 1. All rooms shall have bathrooms which shall be equipped with fittings of the highest quality befitting a luxury hotel with twenty-four (24) hour service of hot and cold running water. 2. Bathrooms shall be provided with bathtubs and showers. 3. Floors and walls shall be covered with impervious material of elegant design and high quality workmanship. Telephones There shall be a telephone in each guest room and an extension line in the bathroom of each suite. Radio/Television There shall be a radio, a television and relayed or piped-in music in each guest room. Cold Drinking Water There shall be cold drinking water and glasses in each bedroom. Refrigerator/Mini Bar There shall be a small refrigerator and well-stocked bar in each guest room. Room Service There shall be a twenty-four (24) hour room service (including provision for snacks and light refreshments). Furnishing and Lighting 1. All guest rooms shall have adequate furniture of the highest standard and elegant design; floors shall have superior quality wall-to-wall carpeting; walls shall be well-furnished with well-tailored draperies of rich materials. 2. Lighting arrangements and fixtures in the rooms and bathrooms shall be so designed to ensure aesthetic as well as functional excellence. There should be adequate fire fighting facilities like sprinkler and smoke detector. Information Materials Room tariffs shall be prominently displayed in each bedroom plus prominent notices for services offered by the hotel, fire exit guidelines, and house rules for guests, including food and beverage outlets and hours of operation. (c) Front Office/Reception There shall be a reception, information counter and guest relations office providing a twenty-four (24) hour porter service and attended by highly qualified, trained and experienced staff. Lounge There shall be a well-appointed lounge with seating facilities the size of which is commensurate with the size of the hotel. Porter Service There shall be a twenty-four (24) hour porter service. Foreign Exchange Counter There shall be a licensed and authorized foreign exchange counter. Mailing Facilities Mailing facilities including sale of stamps and envelopes shall be available in the premises. AcICHD Long Distance/Overseas Call Long distance and overseas call telephone shall be available in the establishment. Telex and Facsimile There shall be telex-transceiver and facsimile facilities in the establishment. (d) Housekeeping Shall be of the highest possible standard. Linen There shall be plentiful supply of all linen/blanket/towels, etc. which shall be of the highest quality available and shall be spotlessly clean. The linen and towels shall be changed everyday. Laundry and Dry Cleaning Laundry and dry cleaning services shall be available at the establishment. Carpeting All public and private rooms shall be of superior quality carpeting, which shall be well kept and clean at all times. (e) Food and Beverage Dining Room There shall be a coffee shop and at least one special dining room, which are well-equipped, well-furnished, and well-maintained serving high-quality cuisine and providing entertainment. Bar Wherever permissible by law, there shall be an elegant and well-stocked bar with an atmosphere of comfort and luxury. Kitchen 1. The kitchen, pantry and cold storage shall be professionally designed to ensure efficiency of operation and shall be well-equipped, well-maintained, clean and hygienic. 2. The kitchen shall have an adequate floor area with non-slip flooring and tiled walls adequate light and ventilation. Crockery 1. The crockery shall be of elegant design and superior quality. 2. There shall be ample supply of it. 3. No piece of crockery in use shall be chipped, cracked or grazed. The silverware shall be kept well-plated and polished at all times. (f) Recreational Facilities Swimming Pool There shall be well-designed and properly equipped swimming pool with a well trained lifeguard. Tennis/Golf/Squash/Gym Facilities There shall be at least one recreational facility or a tie-up with one within the vicinity of the hotel. (g) Entertainment Live entertainment shall be provided. (h) Engineering and Maintenance Maintenance Maintenance of all sections of the hotel ( i.e. building, furniture, fixture, etc.) shall be of superior quality. Ventilation There shall be an adequate ventilation system of advanced, reliable, and efficient quality in all areas of the hotel. Lighting There shall be adequate lighting in all public and private rooms. TAIaHE Emergency Power There shall be a high-powered generator capable of providing sufficient lighting for all guest rooms, hallways, public areas/rooms, operating elevators, food refrigeration and water services. Fire Prevention Facilities The fire prevention facilities shall conform to the requirements of the Fire Code of the Philippines. (i) General Facilities Outdoor Area The hotel premises shall have a common outdoor area for guests ( i.e. a roof garden or spacious common terrace). Parking/Valet There shall be an adequate parking space and valet service. Function/Conference Facilities There shall be one or more of each of the following conference rooms, banquet halls (with a seating capacity of not less than 200 people) and private dining rooms. Shops There shall be a barbershop, recognized travel agency/tour counter, beauty parlor and sundries shop. Security Adequate security on a 24-hour basis shall be provided in all entrances and exits of the hotel premises. Medical Service A medical clinic to service guests and employees shall have a registered nurse on a 24-hour basis and a doctor on call. (j) Service and Staff Professionally qualified, highly trained, experienced, efficient and courteous staff shall be employed. The staff shall be in smart and clean uniforms. (k) Special Facilities Business center, limousine service and airport transfers shall be provided. (l) Insurance Coverage The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. SECTION 23. Requirements for a First Class Hotel . The following are the minimum requirements for the establishment, operation and maintenance of a First Class Hotel: (a) Location 1. The locality and environs including approaches shall be such as can be suitable for a first class hotel of international standard. 2. The faade, architectural features and general construction of the building shall have the distinctive qualities of a first class hotel. (b) Bedroom Facilities and Furnishing Size All single and double rooms shall have a floor area of not less than twenty-five (25) square meters, inclusive of bathrooms. Suite There shall be one (1) suite per forty (40) guest rooms. Bathrooms 1. All rooms shall have bathrooms which shall be equipped with fittings of highest quality befitting a first class hotel with twenty-four (24) hour service of hot and cold running water; 2. Bathrooms shall be provided with showers and bathtubs. 3. Floors and walls shall be covered with impervious material of aesthetic design and high quality workmanship. Telephone There shall be a telephone in each guest room. Radio/Television There shall be a radio, television and relayed or piped-in music in each guest room. Cold Drinking Water There shall be cold drinking water and glasses in each bedroom. Room Service There shall be a twenty-four (24) hour room service including provision for snacks and light refreshments. Furnishing and Lighting 1. All guest rooms shall have adequate furniture of very high standard and very good design; floors shall have wall-to-wall carpeting; or if the floor is of high quality (marble mosaic, etc.), carpets shall be provided and shall be of size proportionate to the size of the rooms; walls shall be well-furnished with well-tailored draperies of a very high quality material. 2. Lighting arrangements and fixtures in the rooms and bathrooms shall be so designed as to ensure functional excellence. cDHAES Information Materials Room tariffs shall be prominently displayed in each bedroom plus prominent notice for services offered by the hotels, including food and beverage outlets and hours of operation, fire exit guidelines and house rules for guests. (c) Front Office/Reception There shall be a reception and information counter providing a twenty-four (24) hour service and staffed by trained and experienced personnel. Lounge There shall be a lobby and well-appointed lounge with seating facilities and size of which is commensurate with the size of the hotel. Porter Service There shall be a twenty-four (24) hour porter service. Foreign Exchange Counter There shall be a licensed and authorized foreign exchange counter. Mailing Facilities Mailing facilities including sale of stamps and envelopes shall be available in the establishment. Long Distance/Overseas Calls Long distance and overseas telephone calls shall be made available in the establishment. Bar Wherever permissible by law, there shall be an elegant and well-stocked bar with an atmosphere of comfort. Kitchen 1. The kitchen, pantry and cold storage shall be professionally designed to ensure efficiency of operation and shall be well-equipped, well-maintained, clean and hygienic. 2. The kitchen shall have an adequate floor area with non-slip flooring and tiled walls and adequate light and ventilation. Crockery 1. The crockery shall be of best quality. 2. There shall be adequate supply of it. 3. No piece of crockery in use shall be chipped, cracked grazed. 4. The silverware shall be kept well-plated and polished at all times. (f) Recreational Facilities Swimming Pool There shall be a well-equipped swimming pool. Fire Prevention Facilities The fire prevention facilities shall conform to the requirements of the Fire Code of the Philippines. (i) General Facilities Parking/Valet There shall be an adequate parking space and valet service. Function/Conference Facilities There shall be special rooms for conference/banquet purposes. Shops There shall be a recognized travel agency/tour counter, barbershop, beauty parlor and sundries shop. Security Adequate security on a 24-hour basis shall be provided on all entrances and exits of the hotel premises. Medical Service A medical clinic to service guests and employees with a registered nurse on a 24-hour basis and a doctor on call shall be provided. (j) Service and Staff Highly qualified, trained, experienced, efficient and courteous staff shall be hired. The staff shall be in a smart and clean uniform. (k) Special Facilities Facilities for airport transfers shall be provided. (l) Insurance Coverage The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. SECTION 24. Requirements for a Standard Class Hotel . The following are the minimum requirements for the establishment, operation and maintenance of a Standard Class Hotel. (a) Location 1. The locality and environs including approaches shall be such as can be suitable for a very good hotel. 2. The architectural features and general construction of the building shall be of very good standard. (b) Bedroom Facilities and Furnishings Size All single and double rooms shall have a floor area of not less than eighteen (18) square meters, inclusive of bathroom. Bathrooms All rooms shall have bathrooms which shall be equipped with showers and fittings of good standard with running water on a twenty-four (24) hour basis and hot running water at selected hours and/or upon request. Telephone There shall be a telephone in each guest room. Hot and Cold Drinking Water There shall be hot and cold drinking water and glasses in each bedroom. Room Service Room service shall be provided at selected hours. Furnishings and Lighting. 1. All guest rooms shall have furniture of very good standard and design; floors shall have a quality carpet; walls shall be well-furnished and drapes shall be well-tailored and of good material; 2. Lighting arrangement and fixtures in the rooms and bathrooms shall be well-designed ensuring complete satisfaction functionally. Information Materials Room tariffs shall be prominently displayed in each bedroom plus prominent notices for services offered by the hotel. Fire exit guidelines, house rules for guests, including food and beverage outlets and hours of operation. (c) Front Office/Reception There shall be a reception and information counter providing a twenty-four (24) hour service and attended by qualified and experienced staff. Lounge There shall be a well-appointed lounge the size of which is commensurate with the size of the hotel. Porter Service Porter service shall be upon request. Foreign Exchange Counter There shall be a duly licensed and authorized foreign exchange counter. (e) Food and Beverage Dining Room There shall be at least one (1) dining room facility, which is well-equipped, well-maintained, and serving good quality cuisine and providing entertainment. cSaATC Hotel, Resort and Restaurant Bar Wherever permissible by law, there shall be a bar. It is an amenity serving food and beverage within the establishment. Kitchen 1. The kitchen, pantry and cold storage shall be professionally designed to ensure efficiency of operation and shall be well-equipped, well-maintained, clean and hygienic; 2. The kitchen shall have an adequate area with flooring and tiled walls and adequate light and ventilation. Crockery 1. The crockery shall be of good quality. 2. No piece of crockery in use shall be chipped, cracked or grazed. The silverware shall be kept well-plated and polished at all times. (f) Engineering and Maintenance Maintenance Maintenance of hotel in all sections ( i.e. building, furniture, fixtures, etc.) shall be of good standard. Emergency Power There shall be a high-powered generator capable of providing sufficient lighting for all guest rooms, hallways, public areas, operating elevators, food refrigeration and water services. Fire Fighting Facilities and Equipment The fire prevention facilities and equipment shall conform to the requirements of the Fire Code of the Philippines. (g) General Facilities Parking There shall be an adequate parking space. Shops There shall be sundry shop. Security Adequate security on a 24-hour basis shall be provided on all entrances and exits of the hotel premises. Medical Service There shall be a registered nurse on a 24-hour duty and a doctor on call. Service and Staff Only qualified, trained, experienced, efficient and courteous staff shall be employed. The staff shall be in clean uniform. Special Facilities Facilities for airport transfer shall be provided. Insurance Coverage The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. SECTION 25. Requirements for All Economy Class Hotel . The following are the minimum requirements for the establishment, operation and maintenance for all Economy Class Hotel. (a) Location 1. The locality and environs including approaches shall be such as are suitable for a good hotel. 2. The architectural feature and general construction of the building shall be of good standard. (b) Bedroom Facilities and Furnishings Size All single and double rooms shall have a floor area of not less than eighteen (18) square meters, inclusive of bathroom. Bathrooms All rooms shall have bathrooms which shall be equipped with showers and basic fittings of modern sanitation, with cold running water on a twenty-four (24) hour basis, and hot running water at selected hours. Telephone There shall be a telephone or a call bell in each guest room. cHDAIS Room Service Shall be provided at selected hours. Furnishings and Lighting All guest rooms shall have the basic furniture of good design; floors shall be well-furnished. Lighting arrangements and fixtures in all rooms and bathrooms shall be of good standard. Information Materials Room tariffs shall be prominently displayed in each bedroom plus prominent notices for services offered by the hotel, including food and beverage outlets and hours of operation, fire exit guidelines and house rules for guests. (c) Front Office/Reception There shall be a reception and information counter providing a twenty-four (24) hour service equipped with telephone. Lounge There shall be reasonably furnished lounge commensurate with the size of the hotel. Porter Service Shall be upon request. Mailing Facilities There shall be mailing facilities. Kitchen There shall be clean, hygienic and well-equipped and maintained kitchen and pantry. The kitchen shall have an adequate floor area with non-slip flooring and tiled walls and adequate light and ventilation. Crockery Shall be of good quality. (f) Engineering and Maintenance Maintenance Maintenance of hotel in all sections shall be of good standard. Ventilation There shall be spare ventilation in all rooms. Lighting There shall be an adequate lighting on all public and private rooms. Emergency Power There shall be a spare generator available to provide light and power in emergency cases. Fire Fighting Facilities and Equipment The fire prevention facilities and equipment shall conform to the requirements of the Fire Code of the Philippines. (g) General Facilities Shops There shall be a sundry shop counter. Security Adequate security on a 24-hour basis shall be provided on all entrances and exits of the hotel. Medical Service The service of a doctor shall be available when needed. (h) Service Staff The staff shall be well-trained, experienced, courteous and efficient. (i) Special Facilities Airport transfers shall be provided upon request. (j) Insurance Coverage The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. ISHCcT ARTICLE IX Basic Requirements for Apartment-Hotels (APARTEL) SECTION 26. Requirements for Apartels . For purposes of registration and licensing, the following are the basic requirements for the establishment, operation and maintenance of apartels: (a) Number of Units the apartel shall have at least a minimum of twenty-five (25) lettable apartments. (b) Apartment each apartment of the apartel shall be provided with living and dining areas, kitchen and bedroom with attached toilet and bath. (c) Living Area the living area shall be provided with essential and reasonably comfortable furniture. (d) Kitchen the kitchen shall be spacious, clean hygienic and adequately equipped with cooking utensils. It shall also be provided with facilities for storage and refrigeration of foods, for disposal of garbage, and for cleaning of dishes and cooking utensils. (e) Dining Area shall be spacious and provided with dining table and chairs, including all essential dining facilities such as, but not limited to, plates, spoons, and forks, drinking glasses, etc. (f) Toilet and Bathroom shall always be clean and have adequate sanitation and running water. (g) Bedroom shall be spacious and provided with comfortable bed. There shall also be provided closet and a mirror. (h) Linen the apartel shall have sufficient number of good and clean linen. (i) Ventilation the apartel shall be sufficiently ventilated and each bedroom shall be provided with an electric fan. (j) Lighting lighting arrangements and fixtures in all rooms shall be adequate. (k) Telephone there shall be a telephone or a call bell button. (l) Elevator an elevator shall be provided for a building of more than three (3) storeys whenever possible. (m) Staff and Services shall be trained, experienced, courteous and efficient. They shall be provided with smart and clean uniforms. (n) Medical Facilities a first aid clinic stocked with appropriate medicines and drugs to service employees and guests shall be provided. Apartel with more than one-hundred (100) apartments shall hire the services of a physician. (o) Fire Fighting Facilities and Equipment shall be in accordance with the Fire Code of the Philippines. (p) Lounge and Reception Center there shall be a reasonably furnished lounge commensurate with the size of the apartel. The reception counter shall be attended by trained and experienced staff and shall also be provided with telephone. (q) Security adequate security on a 24-hour basis on all entrances and exits of the apartel premises. (r) Insurance The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. The apartel staff shall see to it that the tenants shall have a good, peaceful and comfortable lodging during their stay in the apartel. ARTICLE X Basic Requirements for Tourist Inns SECTION 27. Requirements for Tourist Inns . For purposes of registration and licensing, the following are the basic requirements for the establishment, operation and maintenance of a Tourist Inn: (a) Location The tourist inn, except those already existing and licensed by the DOT, shall be located along the principal roads and highways of transportation routes. CAacTH (b) Bedroom Facilities and Furnishings All bedrooms shall have attached toilet and bath equipped with 24-hour service of running water. They shall have adequate natural as well as artificial light and ventilation and shall be furnished with comfortable beds and quality furniture (mirror, writing table, chair, closet dresser per room). Wall shall be painted, wall papered or architecturally designed, clean and pleasing to the eyes. Windows shall be furnished with clean and appropriate draperies. Floors shall be of good flooring materials. All single bedrooms shall have a floor area of not less than nine (9) square meters and all twin or double rooms shall have a floor area of not less than sixteen (16) square meters. There shall be adequate supply of good clean linen, blankets, and towels that shall be changed regularly in each occupied room. (c) Facilities There shall be well-equipped, well-furnished and well-maintained dining room/restaurant for its guests as well as the public in general. A kitchen, pantry and cold storage shall be designed and organized to ensure efficiency of operation and shall be well-maintained, clean and hygienic. Washing of cooking utensils, crockery, cutlery, glassware, etc. shall be sanitarily done. Adequate security shall be provided to all guests and their belongings. Inns with more than fifty (50) lettable rooms shall have emergency power facilities to light the common areas and emergency exits in case of power failure. (d) Parking There shall be adequate parking space for vehicles proportionate to the number of lettable rooms and other public facilities of the inn. (e) Reception There shall be a reception and information counter attended by qualified, trained, and experienced staff. There shall be a lobby and a well-appointed lounge for seating and/or reading purposes. (f) Telephone There shall be adequate telephone facilities for the use of all guests in all public areas. Services for long distance telephone or overseas calls shall be made available to guests. (g) Radio/Television There shall be provisions for radios and/or television sets for the guests upon request. (h) Dining Room There shall be well-equipped, well-furnished and well-maintained dining room/restaurant for its guests as well as the public in general. A kitchen, pantry and cold storage shall be designed and organized to ensure efficiency of operation and shall be well-maintained, clean and hygienic. (i) Security Adequate security shall be provided to all guests and their belongings. (j) Emergency Power Inns with more than fifty (50) lettable rooms shall have emergency power facilities to light the common areas and emergency exits in case of power failure. (k) Fire-fighting Facilities Adequate fire-fighting facilities shall be available as required and specified by the local fire department in the locality and/or the Fire Code of the Philippines. (l) Insurance The establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. ARTICLE XI Basic Standard Requirements for Pension Houses, Lodging Houses, Retreat Houses, Homestays and Government Lodging Facilities, Dormitories, and Campsites A. Pension Houses/Lodging Houses/Retreat Houses SECTION 28. Minimum Basic Requirements . For purposes of licensing and registration, the following are the basic requirements for the establishment, operation and maintenance of Pension Houses/Lodging Houses/Retreat Houses: (a) Number of Units a pension house shall have at least five (5) lettable rooms. (b) Bedrooms the bedrooms shall be provided with sufficient number of comfortable beds commensurate with the size of the rooms. Each room shall have adequate natural as well as artificial light and ventilation. It shall be provided with at least a writing table, closet, and a water jug with glasses proportionate to the number of beds in the room. Rooms shall be clean and presentable and reasonably furnished to depict the true atmosphere of a Filipino home. IAETDc (c) Common Toilet and Bathroom the establishment shall provide a toilet and bathroom to be used in common by the guests. There shall be at least one (1) bathroom/shower for every five occupants in all lettable rooms. (d) Linen there shall be adequate supply of clean linen and towels. Soap and tissue paper shall be provided at all times. (e) Living Room there shall be a reasonably furnished lounge or living room area commensurate to the size of the pension where guests may receive visitors or watch television or read. (f) Dining Room the pension house shall have a dining room, which shall be available for use of its guests. (g) Insurance the establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. (h) Signages all signages to be installed must be in accordance with existing city ordinances of Baguio (COB). (i) Personnel well groomed, efficient, courteous. (j) Emergency Facilities and Equipment shall be in accordance with the Fire Code of the Philippines. B. Homestay and Government Lodging Facilities SECTION 29. Minimum Basic Requirements . For purposes of licensing and registration, the following are the basic requirements for the establishment, operation and maintenance of homestay and government lodging facilities: (a) Contract or written agreement between the host and student. A contract will outline what is expected of the homestay and may include items such as: Chores to perform (cleaning, laundering) Curfews Use of the internet, television Use of the telephone Guest visits Smoking/drinking rules. (b) Details of what is being provided by the host in terms of: Accommodations Furniture/facilities Meal provisions Transportation Communications (internet, telephone) Entertainment (TV, radio). (c) The host must provide a private room for sleep and study that has a lock and a washroom must be available that is convenient for the student to use. C. Campsites SECTION 30. Minimum Basic Requirements . For purposes of licensing and registration, the following are the basic requirements for the establishment, operation and maintenance of campsites: (a) Fireplaces or fire pits in which to build campfires (this can be a circle of rocks, a metal enclosure, a meal grate, a concrete spot, or even just a hole) (b) Pit toilets (outhouses) (c) Road access for vehicles (d) Picnic tables (e) Piped potable water (f) Flush toilets and showers (g) Utility hookups, such as gas, propane, water, electricity and sewer, primarily for the use of travel trailers, recreational vehicles, or similar land transport units. (h) A small convenience store (i) Raised platforms on which to set up tents (j) Shower facilities (with or without hot water) (k) Marked spaces indicating a boundary for one camper or a group of campers (l) Reservations to ensure there will be available space to camp (m) Wood for free or for sale for use in cooking or for a campfire (n) A gravel or concrete pad on which to park a vehicle DcHSEa (o) Garbage cans or large rubbish bins in which to place refuse D. Dormitories SECTION 31. Minimum Basic Requirements . For purposes of licensing and registration, the following are the basic requirements for the establishment, operation and maintenance of dormitories: (a) Size of Rooms 1. All buildings erected or used as dormitories shall have their rooms of such size that an air space of not less than fourteen cubic meters shall be provided for each applicant. 2. In order that the moral well-being of female boarders may be safeguarded, all dormitories shall provide for separate quarters for the ladies and the gentlemen with separate and distinct entrances and exits to their respective halls, and when not feasible only one sex may be admitted in the dormitory. 3. There must at all times be a house mother for female boarders and a dorm master for male boarders. They shall be charged with the active management of the dormitory and shall act as a mother or father to the boarders. They shall maintain log books which shall show among others the number of boarders or lodgers the dormitory has and the whereabouts of all boarders and lodgers at any time of the day. (b) Sufficient Bath, Toilet and Sewage Disposal Facilities to be provided Convenient and adequate toilet facilities shall be provided, located, constructed and maintained, and that they shall not be offensive to the users nor become breeding places for flies, shall have no leakage or seepage and shall not offer possible pollution of any adjacent water sources. There shall be at least one (1) water closet or approved latrine and bathroom for every ten (10) persons that occupy such premise. (c) Water Supply 1. Water supplies to dormitories for drinking and ordinary purposes shall be adequate and of sanitary quality. 2. Wells or springs used as sources of water supply shall be constructed and located to preclude their pollution by seepage from cesspools, privies, sewers, stables, or manure piles, or by surface drainage. The water from such sources shall be obtained by free gravity flow or by metal pump so arranged as to provide for delivery of water of sanitary quality. 3. No common drinking cup shall be provided. All drinking fountains when provided shall be of sanitary design and construction. (d) Protection of Food Supplies Adequate provisions shall be made for sanitary storage, handling, and protection of food supplies. (e) Dish Washing Adequate facilities including a plentiful supply of hot water for the washing of dishes and utensils shall be washed, and disinfected effectively after each use. (t) Sanitary Maintenance Dormitories shall be kept in good repair and in clean and sanitary condition at all times and all filth, household refuse, and other wastes which are offensive or injurious to health shall be effectively removed every day. (g) Animals Prohibited Dogs, cats, fowls, and other pets shall not be kept in dormitories except in appropriate kennels or cages separate from living quarters. (h) Health Certificate All persons employed in any dormitory in any capacity shall undergo medical examination as required for the issuance of up-to-date health certificates. (i) Kitchen Storage There shall be separate kitchen provided with running water, a paved floor, and a separate water closet. SCaITA (j) Study Halls Whether it is a lodging or boarding dormitory for female and male students, there shall be adequate study halls provided with adequate study tables, chairs and lighting facilities. (k) Safety Devices/Security Fire escapes, fire alarms, fire extinguishers, telephones, and security guards. (l) Study Needs Study room and library equipped with reading tables and adequate lighting facilities. (m) Such Other Requirements A receiving room and social hall that should be furnished with necessary furniture and other items which will create the atmosphere of a home away from home. A receiving room may be convertible to become a social hall when needed. ARTICLE XII Minimum Requirements for Travel Agencies/Travel Operators/Travel and Tour Consultants SECTION 32. Office Requirements . The Travel Agencies/Tour Operators/Travel and Tours Consultants shall comply with the following office requirements before operation: (a) It shall be located in a commercial or residential area/district with a minimum space of twenty-five (25) square meters. If located within a residential area, it must be a separate unit/room with interiors/semblance/significance of an office. (b) It shall be used exclusively for the travel agency, tour operations and/or travel and tour consultancy services and may not be consolidated with any business where immigration and/or job placement is the regular service to be provided or any other business not related to travel and tours. (c) It shall be easily identifiable with an appropriate signage, SEC or DTI and BTC registration number, and DOT accreditation, if applicable. (d) It must be equipped with any communication facilities and a computerized reservations system subscribed with any computerized reservation system service provider. (e) There must be a contract of lease to prove that the office space intended for the use of the agency/operator/consultant. In case the owner of the agency is also the owner of the building or premises concerned, proof of ownership must be submitted. ARTICLE XIII Basic Requirements for Tourist Land Transportation Vehicles and Drivers SECTION 33. Requirements . For purposes of registration and licensing, the following are the basic requirements for the operation and maintenance of a tourist transport ( including public utility vehicles ) and driver: (a) Certificate of Public Convenience a tourist transport operator must possess a valid franchise or Certificate of Public Convenience. (b) Registered Carrying Capacity a tourist transport operator shall only be allowed to apply for license for the number of units covered by its franchise. (c) Roadworthiness to be registerable, every tourist transport must be found roadworthy by the Baguio Tourism Council in coordination with the LTO, and shall not, in the case of bus or coaster, be more than ten (10) years reckoned from the year of manufacture; nor more than five (5) years for a tourist car/taxi/van. (d) Left-Hand Drive every tourist transport shall be left-hand drive. (e) Ventilation every tourist transport shall be properly equipped with adequate air conditioning units unless otherwise requested by the customer. (f) Fire-Fighting Facilities a tourist transport shall be provided or installed with at least one (1) portable fire extinguisher for the protection of its passengers. (g) Imprint of Company's Name and Logo the company's name and logo shall be imprinted at the rear and sides, respectively, of the tourist transport. (h) Public Address System for tourist buses and coasters, a public address system must be installed. (i) First Aid Kit every tourist transport shall be provided with a first aid kit and an adequate supply of emergency medicines. aTHCSE (j) Interior Facilities every vehicle shall be provided with clean, good condition and comfortable seats, windows, seat belts, lights and seat cover. (k) Storage Space a tourist transport shall have enough legroom and storage space. (l) Garage every tourist transport operator shall provide an adequate garage and repair shop for the maintenance of its equipment as well as a parking space sufficient to accommodate all its registered units. (m) Insurance the establishment must be provided or covered with Comprehensive General Liability (CGL) Insurance. (n) Proper uniform, well groomed, and driver's I.D. (o) Communication equipment. ARTICLE XIV Classification of Restaurants SECTION 34. Classes of Restaurants . For purposes of registration and licensing, restaurants shall be classified as follows: a) Class "A" b) Standard Restaurants c) Fast Food d) Carinderia e) Catering Services. A. Basic Standard Requirements for Class "A" Restaurants SECTION 35. Minimum Basic Requirements . For purposes of registration and licensing, the following are the minimum requirements that must be complied with for Class " A " restaurants: (a) Location the locality and environs including approaches shall be pleasant and provided with proper ingress for customers. (b) Reception a reception shall be available to usher in guests. A waiting lounge with a telephone shall also be provided. (c) Dining Room shall be adequate in size with sufficient and well-maintained furniture. Cleaning materials shall be kept clean at all times. Atmosphere the restaurant shall have a pleasant atmosphere. Cuisine there shall be a cuisine of good quality and presentation, which may be of special interest to tourists available during the normal meal hours, and served with distinction. Raw food used shall meet minimum government and international standards of grading quality. Menu Book shall be presentable, clean and easy to read with the menu items listed in logical sequence. All items shall be made available at all times on a best effort basis. Linen all tables shall have clean tablecloth, napkins of good quality, not faded nor with frayed edges and should be changed after every service. Crockery no piece of crockery, cutlery and tableware in use shall be chipped cracked or grazed. The silverware shall be kept polished and clean at all times. (d) Service and Staff adequate number of well-trained, well-groomed, experienced, efficient and courteous staff shall be employed. cAaDHT (e) Comfort Rooms shall be of good quality fixtures and fittings and provided with running water. The floor and walls shall be covered with impervious materials of good quality workmanship and shall be kept clean and sanitary at all times. Tissue paper, soap, paper towels and/or hand drier shall be provided. (f) Kitchen the kitchen, pantry and cold storage shall be in good operating condition at all times and shall be well-equipped and hygienic. Equipment necessary to maintain a high standard of sanitation and hygiene shall be installed and used. (g) Lighting adequate lighting arrangement and fixtures shall be installed in the dining rooms, public rooms, comfort rooms, corridors and other public areas. (h) Maintenance all sections of the restaurant shall be maintained properly at all times. A periodic vermin control program shall be maintained for all establishments. (i) Fire-fighting Facilities and Equipment adequate fire-fighting facilities and equipment shall be provided in accordance with the Fire Code of the Philippines. B. Basic Standard Requirements for Standard Restaurants (a) Location the locality and environs including approaches shall be pleasant and provided with proper ingress for customers. (b) Parking there shall be adequate, secured parking space provided free to customers. (c) Reception a reception shall be available to usher in guests. A waiting lounge with a telephone shall also be provided. (d) Dining Room shall be adequate in size with sufficient and well-maintained furniture. Dining materials shall be kept clean at all times. Atmosphere the restaurant shall have a pleasant atmosphere. Cuisine there shall be a cuisine of good quality and presentation, which may be of special interest to tourists available during the normal meal hours and served with distinction. Raw food used shall meet minimum government and international standards of grading quality. No liquor shall be served. Menu Book shall be presentable, clean and easy to read with the menu items listed in logical sequence. All items shall be made available at all times on a best effort basis. Linen all tables shall have clean tablecloth, napkins of good quality, not faded nor with frayed edges and should be changed after every service whenever applicable. Crockery no piece of crockery, cutlery and tableware in use shall be chipped cracked or grazed. The silverware shall be kept polished and clean at all times. (e) Service and Staff adequate number of well-trained, well-groomed, experienced, efficient and courteous staff shall be employed. (f) Bar the bar shall be well-stocked at all times. (g) Comfort Rooms shall be of good quality fixtures and fittings and provided with running water. The floor and walls shall be covered with impervious materials of good quality workmanship and shall be kept clean and sanitary at all times. Tissue paper, soap, paper towels and/or hand drier shall be provided. (h) Kitchen the kitchen, pantry and cold storage shall be in good operating condition at all times and shall be well-equipped and hygienic. Equipment necessary to maintain a high standard of sanitation and hygiene shall be installed and used. (i) Lighting adequate lighting arrangement and fixtures shall be installed in the dining rooms, public rooms, comfort rooms, corridors and other public areas. (j) Maintenance all sections of the restaurant shall be maintained properly at all times. A periodic vermin control program shall be maintained for all establishments. (k) Emergency Facilities adequate fire-fighting facilities and equipment shall be provided in accordance with the Fire Code of the Philippines. C. Basic Standard Requirements for Fast Food (a) Location the locality and environs including approaches shall be pleasant and provided with proper ingress for customers. HCaDIS (b) Dining Room shall be adequate in size with sufficient and well-maintained furniture. Cleaning materials shall be kept clean at all times. (c) Atmosphere the restaurant shall have a pleasant atmosphere. (d) Service and Staff adequate number of well-trained, well-groomed, experienced, efficient and courteous staff shall be employed. (e) Comfort Rooms shall be of good quality fixtures and fittings and provided with running water. The floor and walls shall be covered with impervious materials of good quality workmanship and shall be kept clean and sanitary at all times. Tissue paper, soap, paper towels and/or hand drier shall be provided. (f) Kitchen the kitchen, pantry and cold storage shall be in good operating condition at all times and shall be well-equipped and hygienic. Equipment necessary to maintain a high standard of sanitation and hygiene shall be installed and used. (c) Atmosphere the restaurant shall have a pleasant atmosphere. (d) Service and Staff adequate number of well-trained, well-groomed, experienced, efficient and courteous staff shall be employed. (e) Comfort Rooms shall be of good quality fixtures and fittings and provided with running water. The floor and walls shall be covered with impervious materials of good quality workmanship and shall be kept clean and sanitary at all times. Tissue paper, soap, paper towels and/or hand drier shall be provided. (f) Kitchen the kitchen, pantry and cold storage shall be in good operating condition at all times and shall be well-equipped and hygienic. Equipment necessary to maintain a high standard of sanitation and hygiene shall be installed and used. Cuisine there shall be a cuisine of good quality and presentation, which may be of special interest to tourists available during the normal meal hours and served with distinction. Raw food used shall meet minimum government and international standards of grading quality. Linen all tables shall have clean tablecloth, napkins of good quality, not faded nor with frayed edges and should be changed after every service whenever applicable. Crockery no piece of crockery, cutlery, and tableware in use shall be chipped, cracked or grazed. The silverware shall be kept polished and clean at all times. (b) Service and Staff adequate number of well-trained, well-groomed, experienced, efficient and courteous staff shall be employed. (c) Kitchen the kitchen, pantry and cold storage shall be in good operating condition at all times and shall be well-equipped and hygienic. Equipment necessary to maintain a high standard of sanitation and hygiene shall be installed and used. (d) Lighting adequate lighting arrangement and fixtures shall be installed in the dining rooms, public rooms, comfort rooms, corridors and other public areas. (e) Maintenance all sections of the restaurant shall be maintained properly at all times. A periodic vermin control program shall be maintained for all establishments. (f) Fire-Fighting Facilities adequate fire-fighting facilities and equipment shall be provided in accordance with the Fire Code of the Philippines. ARTICLE XV Basic Standard Requirements for Tourist Shops, Department Stores and Shopping Malls SECTION 36. Minimum Basic Requirements . For purposes of registration and licensing, the following are the minimum basic requirements that shall be complied with by tourist shops, department stores and shopping malls: (a) Physical Requirements the establishments shall be fronting a major street or thoroughfare or situated in a shopping center/mall. The entrance and display windows shall be attractively designed and adequately illuminated. The furniture and dcor of the establishment shall be presentable and functional at all times. The establishment shall provide for well-maintained rest rooms or in the event that the shop is located in a shopping mall or commercial building, the common/public rest rooms shall be made available to the clients and visitors. In case of department stores, the store shall be an edifice or building or may form part of a shopping mall/center. (b) Staff all members of the staff shall be well groomed, courteous, disciplined, and efficient at all times. (c) Services goods displayed in the shop window or showcase shall be provided with clearly written price tags. A wide selection of goods shall be in stock. A receipt shall be supplied to the tourist for its purchase. The full name and address of the establishment shall be printed on the receipt. Purchase shall be indicated. The business shall be responsible for the maintenance of its facilities and its immediate surrounding. In case of antique shops, a certificate confirming authenticity shall be attached to each article in accordance with guidelines/instructions of the National Museum. ARTICLE XVI Cocktail Lounges/Night Clubs/Beer Gardens/Disco Clubs/Karaoke Bars SECTION 37. Minimum Basic Requirements . For purposes of licensing and registration, the following are the minimum requirements that must be complied with by cocktail lounges, night clubs, beer gardens, disco clubs, and karaoke bars: (a) Location subject to the provisions of existing laws and ordinance, locality and environment including approaches should be pleasant with an atmosphere of comfort. The facade and the architectural features of the building shall be appropriately designed. (b) Reception Counter there shall be a reception counter with a telephone attended by highly qualified, trained and experienced staff. A receptionist shall be available to usher in customers. ScHADI (c) Engineering and Maintenance Lighting technologically advanced efficient and adequate lighting arrangement and fixtures shall be installed in all areas of the establishment. Ventilation the premises shall be well ventilated. Emergency Power there should be a high-powered generator capable of providing sufficient lighting in all areas of the establishment, including food refrigeration and water services. Maintenance shall be of acceptable standard and shall be on a continuing basis, taking into consideration the quality of materials used as well as its upkeep. Regular and hygienic garbage disposal system shall be maintained. Sanitation measures shall be adopted in accordance with the Sanitation Code of the Philippines. Fire-Fighting Facilities and Equipment the fire prevention facilities and equipment shall conform to the requirement of the Fire Code of the Philippines. Signages All signages to be installed must be in accordance with existing city ordinances of Baguio (COB). (d) Food and Beverage dining room shall be well equipped, well-furnished and well-maintained serving good quality cuisine with good presentation which may be of special interest to tourists. It should be available during normal meal hours and served with distinction. Raw food used shall meet minimum government and international standards of grading quality. Flooring materials shall be kept clean at all times. Bars should be well-stocked at all times with an atmosphere of comfort. (e) Kitchen/Pantry/Cold Storage should be professionally designed to ensure efficiency of operation and should be well-equipped, well-maintained, clean and hygienic. Should have an adequate floor area with non-slip flooring and tiled walls, adequate light and ventilation. (f) Crockery should be best designed and with quality. Should have adequate supply of it. No piece of crockery in use shall be chipped, cracked or grazed. The silverware shall be kept well-plated and polished at all times. (g) Menu/Beverage Book shall be presentable, clean and easy to read with items listed in logical sequence and should be made available at all times on a best effort basis. (h) Linen all tables shall have clean tablecloth napkins of good quality, should not be faded nor with frayed edges and should be changed after every service. (i) Comfort Room shall be of good quality fixtures and fittings and provided with running water. The floor and walls shall be covered with impervious materials of good quality workmanship and shall be kept clean and sanitary at all times. Tissue paper, soap, paper towels and/or hand drier shall be provided. (j) Entertainment live entertainment should be provided but strictly no lewd, obscene or bold shows as prescribed by law. (k) Staff and Service adequate number of trained, experienced, courteous and efficient staff shall be employed. They shall wear smart and clean uniforms at all times. (l) Security adequate security shall be provided on all entrances and exits of the establishments. (m) Employee Facilities adequate and well-maintained locker rooms and bathrooms for male and female employees shall be provided. (n) No Lewd Shows must comply with the rules and regulations in showing lewd shows that may affect moral decency. aICcHA SECTION 38. Precautionary Measures . Management shall post sufficient and visible signs in strategic areas of the cocktail lounge/night clubs/bars to warn and/or inform the guests and customers of the rules and regulations, fire exit guidelines, including hours of operation, to observe while inside the premises. SECTION 39. Prohibited Acts and Practices . Littering in cocktail lounges, nightclubs and bars shall be strictly prohibited. Cocktail lounge, nightclub and bar owners shall keep their premises clean and shall adopt their own anti-littering measures. Cocktail lounge, night club, and bar owners/operators shall not allow gambling of any form and disorderly conduct of any kind in its premises. No lewd shows that may affect moral decency. Minors are not allowed to enter the premises. Guests/customers wearing sando and slippers shall not be allowed to enter. Firearms and deadly weapons are strictly prohibited inside the premises. ARTICLE XVII Creation of the Baguio Tourism Council SECTION 40. The Baguio Tourism Council (BTC) . There shall be a Baguio Tourism Council to be organized with the following characters and powers: (a) It shall be an independent incorporated foundation, non-stock, non-political and non-sectarian, composed of unlimited members and Board of Directors that shall not be more than fifteen (15) in accordance with the Corporation Code. (b) The BTC shall be self-perpetuating whereby its character shall provide how its members are admitted and its Board of Directors and Officers are elected from year to year: Provided, however, that the City Government and National Agencies involved in tourism shall always be represented in the Board of Directors. (c) Its finances shall be raised from subsidies or grants from the government, local and national, membership fees of members, grants from other government and non-government institutions, fund-raising activities, business or income generating ventures that it may engage in and other ways of raising funds for its own existence and operations. (d) Its main purpose, function and objective is to be the policy recommending body that is tasked for the promotion, development and maintenance of tourism in the City of Baguio and its environs. (e) To be able to achieve the mandate of its creation, it shall have the power to determine its organization, administrative and operational structures from time to time as it goes on with its operation: Provided, however, that in all its structures of membership and its policy making levels, the government shall always have sufficient representations without sacrificing the principles of practicality, efficiency, mobility, simplicity and unity. PART THREE Registration and Licensing of Tourism Oriented/Related Establishments ARTICLE XVIII SECTION 40a. Delineation of Functions of the Baguio Tourism Council (BTC), The City Tourism Office (CTO), Department of Tourism-Cordillera Administrative Region (DOT-CAR), and The Sanggunian Panlungsod Committee on Tourism, Special Events, Parks and Playgrounds . (a) Baguio Tourism Council is the policy-making and recommendatory body with the following functions, to wit: i. Ensures the proper implementation of the Baguio Tourism Code. ii. Ensures close coordination with various government/nongovernment offices, organizations and individuals and provides updates accordingly with regards to tourism. iii. Ensures that benchmarks are sustained with regard to the standards. iv. Provides significant representation recommendatory to the approval of accreditations as per review of collected data. v. Promotes and initiates feasible and practicable means to the elevation of standards of all tourism-related and oriented establishments. EHaASD vi. Recommends and initiates programs and projects beneficial to the development to the city's tourism industry. vii. Promotes the participation of the community in endeavors that open avenues for the city's marketing and promotion. viii. Participates in massive information dissemination programs of the tourism industry. (b) City Tourism Office is the implementing body of the Tourism Code with the following functions, to wit: i. Provides relevant data on matters pertaining to tourism. ii. Provides secretariat support and other services pertaining to government processes and procedures. iii. Defines the budgetary requirements for secretariat and operations, and proposes the same for approval. iv. Convenes the Composite Inspection Team for coordination meetings. v. Schedules and participates in inspection operations. vi. Collects data and processes the same for records keeping purposes for the general database of the Baguio Tourism Council. vii. Processes accreditation permits as dictated by the results of the scheduled inspection of the tourism-related/oriented establishment in question. viii. Performs such other functions as may be needed in the implementation of this Code. (c) Department of Tourism-Cordillera Administrative Region (DOT-CAR) is the recommendatory body that assists in the implementation of the Baguio Tourism Code, with the following functions, to wit: i. Recommends updates on accreditation processes/procedures of tourism-related and oriented establishments. ii. Promotes the participation of the city in national and international tourism and trade exhibits. iii. Provides avenues for marketing and promotion endeavors of the city. (d) Sangguniang Panlungsod (City Council) Committee on Tourism, Special Events, Parks and Playgrounds is the body that provides legislative support through the policies and guidelines for programs initiated by the government and the private sector with the following functions, to wit: i. Acts as consultant with regard to legal/legislative and government procedures and modes of engagements with regard to programs, activities, and projects for tourism development. ii. Represents the Baguio Tourism Council and the city together with other significant representations of the industry in endeavors of domestic and international relations for trade, barter and investment opportunities. iii. Prioritizes matters involving tourism development in initiating government action through the aid of legislation. ARTICLE XIX SECTION 41. Mandatory Registration and Licensing of Tourism-Oriented Establishments . No person; natural or juridical, shall keep, manage, or operate any building, edifice or premises, or a completely independent part thereof, for the purpose of engaging in the tourism-oriented business, without having been first issued a valid license from the BPLO to operate the same. SECTION 42. Application for Registration and License . Any person, partnership, corporation or other entity desiring to establish maintain and/or operate a tourism-oriented establishment shall apply for their license and permit from the BPLO prescribed for such purpose. DaIAcC (a) Tour Guides only Filipino citizens may qualify as tour guides except when a person of different nationality is granted a permanent resident status and provided, that Filipino tour guides are allowed to guide tours in said national's country. He/she must be a bona fide member of a duly registered tour guide association or duly licensed travel agency accredited by the City Government of Baguio or the DOT. He or she is a member of a duly licensed travel agency and/or tour operator who guides/lectures foreign or domestic tourists on sights seen and places visited, looks after their well being, and serves to ensure the on-time delivery of confirmed services in a package tour on behalf of the travel agent/tour operator/consultant, for a fee, commission or any form of monetary consideration. (b) Travel Agency in case of travel agency with business address in Baguio City, the following may apply for registration and license: (1) A Filipino citizen; (2) Partnership organized under the laws of the Philippines, at least 60% of the capital of which is owned by the Filipino citizens; (3) Corporation organized under the laws of the Philippines, at least 60% of the capital of which is owned by the Filipino citizens; and (4) Such other establishments not covered by preceding paragraphs of this Section may apply for the same privileges: Provided, That they first comply with all the requirements of the rules and regulations provided in this Ordinance and existing laws. SECTION 43. Who Are Authorized to Sign the Application . In the filing of application for registration and license, the following shall be considered authorized to sign said application. (1) In case of sole proprietorship, the owner thereof or his authorized representative. (2) In case of partnership, one of the partners designated on a sworn certification by all the partners to sign the application. (3) In case of corporation, the person named in the board resolution as authorized to sign the application or person so designated in its by-laws. SECTION 44. Documents Required to Support Application for Registration . For newly established tourism business, unless otherwise indicated in the form, the application shall be composed of four (4) copies of the following documents: (a) Resort (1) In the case of corporation or partnership, a certified true copy of the latest Articles of Incorporation, its by-laws, or latest Articles of Partnership and Amendments thereof duly registered with SEC, and the latest business name certificate, in case of single proprietorship, business name certificate and amendments thereof, if any. (2) A list of the names of all officials and employees and their respective designation, nationality, home address, for alien personnel, valid visa from Bureau of Immigration are the proper permit from the Department of Labor and Employment shall be submitted. (3) Annual General Liability Insurance for guests as prescribed by law. (4) Schedule of current room rates. (5) List of proprietors, principal owners, major partners, major stockholders, controlling members, their nationalities, capital contributions, stock or participation; in the case of a corporation, such list must indicate the quantity, par value and type (whether voting or non-voting) of the stock with an indication of the absolute total value of the outstanding voting stocks and its ratio to the total value of the outstanding non-voting stock; and in all cases, the list shall be accomplished by proof of their financial capacity such as sworn statements of assets and liabilities, and income tax returns. (6) Sworn Certificate or list containing the names of the hotel keeper/manager, assistant hotel keeper/manager, and other members of the hotel staff and their respective designations, nationalities, home addresses, and accompanied by a passport size photo of each of them. TAacHE (7) Joint venture and/or technological assistance agreements, if any, existing or proposed and about to be entered into with foreign nationals. (b) Hotel (1) In the case of corporation, partnership, single proprietorship, or other entity, a certified copy of its articles of incorporation and by-laws, constitution and by-laws, articles of partnership or association; or registration of business name and amendments thereof, duly registered with the Securities and Exchange Commission or other registering government agency, as the case may be. (2) Resolution of the Board of Directors of the corporation, association or other entity authorizing the filing of the application and designating its representative authorized to act for and in its behalf. (3) In the case of a corporation, association or other entity, list of directors and other principal officers and their respective nationalities. If any director or officer is a naturalized Filipino citizen, such fact should be stated, accompanied by a copy of his certificate of naturalization or citizenship. (4) List of proprietorship, principal owners, major partners, major stockholders, or controlling members, their nationalities, capital contribution, stock or participation; in case of a corporation, such list must indicate the quantity, par value and type (whether voting or non-voting) of the stock with an indication of the absolute total value of the outstanding voting stocks and its ratio to the total value of the outstanding non-voting stocks; and, in all cases, the list shall be accomplished by proof of their financial capacity such as sworn statements of assets and liabilities, and income tax returns. (5) Sworn Certificate or list containing the names of the hotel keeper/manager, assistant hotel keeper/manager, and other members of the hotel staff and their respective designations, nationalities, home addresses, and accompanied by a passport size photo of each of them. (6) Joint venture and/or technological assistance agreements, if any, existing or proposed and about to be entered into with foreign nationals. (7) Schedule of current room rates, F and B prices of menu for hotels. (8) Comprehensive General Liability Insurance for guests as prescribed by law. (9) Such other papers or documents as may be required by pertinent laws, rules and regulations. (c) Tourist Inn/Apartel (1) In the case of corporation or partnership, a certified true copy of the Articles of Incorporation, its by-laws, or Articles of Partnership and amendments thereof duly registered with Securities and Exchange Commission, and Business Name Certificate. (2) A list of the names of all officials and employees and their respective designation, nationality, and home address. For alien personnel, valid visa from the Bureau of Immigration and Deportation and the proper permit from the Department of Labor and Employment. (3) Annual General Liability Insurance for guests in the amount of not less than the following: Apartel... P10,000.00 Inn.. P10,000.00. (d) Travel Agency/Tour Operators/Consultant (1) Documents required for registration: (a) A copy of the Certificate of Registration with the Securities and Exchange Commission or Department of Trade and Industry; (b) Two-year projected financial statements to reflect, among other things, a minimum working capital of Two Hundred Fifty Thousand Pesos (P250,000.00); (c) Surety bond in the amount of Two Hundred Fifty Thousand Pesos (P250,000.00) issued by a duly accredited bonding company of good standing in favor of the Baguio City Government and conditioned to answer for any liabilities, which shall be valid for one (1) year from the date of issuance of the license; (d) Complete list of personnel together with one (1) 1x1 photo of each and notarized certification of the General Manager that they are without criminal record; (e) In the case of the Manager, proof that he/she has at least three (3) years experience on the actual operation of a travel agency (inbound)/tour operation (outbound), or any tourism-related establishment/institution or has earned a degree of Bachelor of Science in Tourism and has successfully completed a Travel Agency and/or Tour Operators Management Course and a computerized reservations and/or ticketing course with any computerized reservations system service provider; and HcDSaT (f) Proof that at least two (2) of its permanent staff are BS Tourism graduates with a computerized reservations and/or ticketing course with an computerized reservation system service provider and with at least one (1) year experience. In the case of a Tour Operator, proof that at least two (2) of its permanent staff has completed a Tour Guiding seminar with an accredited tourism-oriented training institution or trainers and with at least one (1) year experience. (2) Additional Requirements Using a Motor Vehicle Proof of LTFRB registration for motor vehicles to be used for tourist travel and tours requirements. (3) Documents to be submitted in support of an Application to Establish an Operative Branch: (a) Resolution signed by all members of the Board of Directors approving its establishment (or authorizing its continuation, if renewal) and designating the person authorized to sign the application; (b) Affidavit executed by the General Manager of the main office acknowledging the existence of the said office, assuming full responsibility of its operations, and certifying that it is not managed or operated by persons/entities other than the duly accredited employees of the office; (c) List of personnel and their respective designations, citizenship, home address and one (1) 1x1 photo of each, together with the notarized certification by the General Manager that they are without criminal record; and (d) Surety Bond of One Hundred Thousand Pesos (P100,000.00) with terms and conditions cited in 1 (b). (e) Tour Guide (1) Proof that the applicant has passed a seminar for tour guides duly conducted by the Department of Tourism or other government agencies duly authorized by the department to conduct seminar: Provided, however, that this requirement may be waived by the City Government with the concurrence of the Department of Tourism where the applicant possesses special academic or professional qualification relevant to tourism. (2) Certificate of good health issued by any duly accredited government physician. (3) Clearance from the National Bureau of Investigation, Police Clearance and Barangay Clearance. (4) In the case of alien applicants, proof of employment with duly licensed agency, permit to work or registration certificate from the Department of Labor and Employment, and proof of reciprocity which shall consist of a certificate by the proper official of the home state of the applicant to the effect that the law of such state allows or permits reciprocal rights to Filipino citizens to engage in tour guiding which must be properly authenticated. (5) Latest Income Tax Return. (f) Tourist Transport Operation (1) Documents required to support application for license to operate: (a) Business name certificate and all amendments thereto, if any, in the case of a corporation or partnership, a certified true copy of the Articles of Partnership and amendments thereto, if any, duly registered with the Securities and Exchange Commission; ASTcaE (b) Proof of ownership or lease over an area adequate to serve as maintenance depot and garage for all its units; (c) A list of names of all officials and employees and their respective designations, nationalities, home addresses, certified correct under oath by the Secretary of the firm or the proprietor himself; (d) Surety Bond in the amount of Ten Thousand Pesos (P10,000.00) issued by a duly licensed insurance or bonding company of good standing in favor of the City Government of Baguio and conditioned to answer for any and all liabilities resulting from or incurred in the course of the tourist transport; and (e) Such other papers or documents as may be required from time to time pursuant to existing laws, ordinances and other legal issuances. (2) Documents Required to Support Application for Registration of Vehicle as Tourist Transport: (a) Certificate of Inspection by the Baguio Tourism Council for the LTO registration of the Tourist Transport/taxis; (b) A copy of the LTFRB (formerly Board of Transportation) Certificate of Public Conveyance franchise or authorization; (c) A copy of the transportation rates as approved by the LTFRB; (d) Compulsory motor-vehicle liability insurance not less than the following: Third Party Liability P20,000.00/unit Passenger Accident P12,000.00/unit. (e) Pictures of the vehicle showing the side, back and front views thereof, with the company's name and logo imprinted at its rear and sides respectively; and (f) Such other papers or documents as may be required from time to time pursuant to existing laws, ordinances and other legal issuances. (g) Tourism-Related Establishment . (1) In the case of corporation or partnership, a certified copy of its Articles of Incorporation, its by-laws or Articles of Partnership and amendments thereof duly registered with the Securities and Exchange Commission, and Business Name Certificate issued by the Department of Trade and Industry; in case of a single proprietorship, Business Name Certificate and amendments thereof, if any; (2) List of names of all officials and employees and their addresses. For alien personnel, valid visa from the Bureau of Immigration and Deportation and the proper permit from the Department of Labor and Employment; (3) Such other requirements as may be requested and/or deemed necessary. Establishments catering exclusively to international tourists with offices in the City shall also be required to secure license and permit from the BPLO. SECTION 45. Creation of a Composite Inspection Team . There is hereby created one Composite Inspection Team to be headed by a team leader designated by the Office of the City Administrator. The other members of the team shall be composed of a representative from each of the following offices/departments: cDSAEI (a) The Business Permits and Licensing Office; (b) The City Engineering Office; (c) The Health Services Office; (d) The Baguio City Police Office; (e) The City Treasury Office; (f) The Sangguniang Panlungsod Committee on Tourism and Special Events, Parks and Playgrounds; (g) The Baguio Tourism Council; (h) The Department of Tourism-Cordillera Administrative Region; (i) The Department of Trade and Industry-Cordillera Administrative Region; and (j) The Department of Labor and Employment-Cordillera Administrative Region. SECTION 46. Functions of the Composite Inspection Team . For all establishments already in operation, the Composite Inspection Team shall have exclusive authority to conduct inspection for purposes of classification. For new establishments, the normal process of requiring the clearances and recommendations for the different technical departments is required. SECTION 47. Periodic Inspection . The Composite Inspection Team shall conduct periodic inspection of tourism establishment and their immediate premises once in six (6) months or as often as when the City Tourism Office so requires. The purpose of said inspection is to find out whether the establishment conforms to the standards set forth by law or ordinance. The inspection shall be conducted at a reasonable time of the day with due regard and respect accorded to privacy of the guests. All inspections shall be covered by mission orders stating therein the scope of authority and such other matters necessary for the purpose. SECTION 48. Access of Inspection Team to Records and Premises . The inspection team shall have access to the Registry Book or Card of the tourism establishments and all parts and facilities thereof, and the right to interview any employee and investigate any fact, condition, or matter which may be necessary to determine any violation or aid in arriving at a just and correct conclusion. SECTION 49. Defects and Deficiencies Found During the Inspection . Where certain defects or deficiencies have been found in the course of inspection, the City Tourism Office shall give directions to the manager/operator of the tourism establishments concerned to rectify/remedy the defects or deficiencies within a period of one (1) week from notice thereof. SECTION 50. Extension of the Period . The City Tourism Office may, for good cause, extend the period within which to remedy the defects or deficiencies noted but in no case shall the period of extension granted exceed two (2) months. SECTION 51. Penalty for Failure to Remedy the Defect, Etc . If the management of any tourism-related establishment fails to remedy the defects or deficiencies noted, the City Tourism Office shall impose the following: Resort/Hotel/Apartel/Tourist Inn/Pension Houses/Homestay and others fine of not less than P5,000.00 for every day of delay in complying with directions, but in no case shall the fine exceed the sum of P50,000.00: Provided, That, were the maximum fine imposable under this section has been reached and the tourism establishment concerned has continuously failed to rectify the defects or complete the deficiencies noted, the City Tourism Office may revoke or suspend the Certificate of Registration and the BPLO may confiscate and suspend the license for such period as may be justified under the circumstances. SECTION 52. Special Inspections . When public interest so requires, the Composite Inspection Teams or any member or members thereof may conduct a special inspection. SECTION 53. Checklist to be Accomplished during Inspection . The City Tourism Office shall provide the necessary checklist to be accomplished by all teams in carrying out its inspection. All findings and/or observations of the teams to be indicated in the checklist should be made in the presence of an authorized representative of the establishments and duly signed/noted by the said authorized representative. SECTION 54. Report of the Inspection Team . Within five (5) days from the date of inspection, the team leader shall submit a report of its finding and/or recommendation to the Office of the City Mayor. It may recommend accreditation to the City Tourism Officer. EDCcaS SECTION 55. Registration Fees . The Baguio Tourism Council may charge registration fees for accreditation of the different facilities, establishments, tourist destinations, and centers. The city government shall charge registration fees as contained in the City Tax Ordinance. SECTION 56. Issuance of Certificate of Registration/License and Sticker . (a) After having determined that all requirements set forth in the preceding sections have been satisfied and/or completed by the applicant, the BPLO and the Office of the City Mayor shall issue the corresponding Certificate of Registration and License. (b) The Baguio Tourism Council shall devise stickers for purposes of classification of different tourism establishment. SECTION 57. Objection to Applications for Registration and License of Premises . Any person may file a written objection to the City Administrator who will then be referring it to the Baguio Tourism Council. The objection shall state the facts upon which it is based and shall be sworn to before a person authorized to administer oath. Upon receipt of such objection the Baguio Tourism Council shall within three (3) days furnish the applicant with a copy of the objection and require him/her to answer within five (5) working days from receipt thereof. Within seven (7) days from receipt of the answer of the applicant, the Baguio Tourism Council shall then conduct a hearing with both parties duly notified and present. The Baguio Tourism Council shall render a decision on the objection within seven (7) days from the start of the hearing and transmit the decision to the Office for City Administration for the issuance or non-issuance of a Business Permit, Certificate of Good Operating Practice and/or accreditation sticker to the applicant. SECTION 58. Validity of Certificate of Registration . The certificate of registration and license of tourism-oriented and tourism-related establishments shall be valid until revoked or canceled for a valid cause. The license shall be renewable on an annual basis. If the tourism-oriented and/or tourism-related establishment concerned has ceased operation for at least six (6) months, it shall re-apply for registration. SECTION 59. Documents/Requirements to be Submitted for the Renewal of License . Application for the renewal of license shall be reported by the following documents: (a) A copy of the amended Articles of Incorporation or Articles of Partnership and By-Laws, if any; (b) List and information sheets of additional personnel, if any, or any change in the manpower complement; (c) Latest Income Tax Return and Audited Financial Statements covering the preceding year's operation: Provided, That if this requirement is not available at the time of renewal, the same shall be submitted not later than 30 April of the current year; (d) A resolution of the Board of Directors authorizing the continuation of business; (e) Proof of renewal of General Liability Insurance (additional requirements for resort, tourist inn, and apartel); (f) Renewal of Surety Bond referred to in Article XIX on additional requirements for tourist transport operation; (g) Barangay Clearance; and (h) Certificate of Good Operating Practice issued by the Composite Team. SECTION 60. Grounds for the Closure of Tourism Establishments, Imposition of Fines, Forfeiture of Bond, Suspension, Cancellation and/or Non-Renewal of License . A. Grounds for the Closure of Tourism Establishments and Cancellation and/or Non-Renewal of License (a) Making any false declaration or statement or making use of any such declaration or statement or document containing the same or committing fraud or any act of misrepresentation for the purpose of obtaining the issuance, grant or renewal of any certificate of registration/accreditation/re-accreditation or license; ISHaCD (b) Failure to comply with or contravening any of the conditions set forth in the license; (c) Failure to meet the standards and requirements for the operation of tourism establishments as prescribed in these rules after the establishment failed to comply; (d) Serious physical injury or loss of life of any guest due to fault or negligence of its official or employee (for resort/hotel/apartel/tourist inn/other tourism-related establishments); (e) Allowing or permitting the tourism establishment, including any of its facilities, to be used for illegal, Immoral, illicit activities, such as gambling, prostitution, etc. (for resort/hotel/apartel/tourist inn/other tourism-related establishments); Managers and/or Operators shall exert all possible efforts not to permit a person whom they know to be drunk and/or have the reason to believe to be either a prostitute, a pedophile or a bad character to occupy any room or to frequent the premises. To accomplish this end, they shall immediately report to the nearest police station the presence in the premises of any such person. (f) Violation of any of the conditions of the LTFRB franchise (for tourist transport operation); (g) Tolerance of gross misconduct, discourtesy, dishonesty, or misrepresentation and/or fraudulent solicitation of business committed by any of the officers or employees against their clients to the detriment of the tourism industry; (h) Willful violation of agreements and/or contracts entered into by the tourism establishment and its clients; (i) The following are grounds of violation; (a) Failure to replace or renew the Surety Bond within fifteen (15) days from the date when said bond is ordered forfeited or confiscated in accordance with these rules or canceled and/or revoked for whatever cause (in case of travel agency); (b) Failure to pay fine, as well as fees, dues, and contribution imposed under existing laws. (c) Failure to submit a notice of any change in its personnel within fifteen (15) working days of such change; (j) Non-settlement of account and/or non-remittance of collections due to carrier of their co-agencies, or any of the government or any individual within the period prescribed by law; (k) Any other acts/omissions that worked against the interest of the tourism industry. In case of Tour Guides, the following are the grounds for cancellation and suspension of license: (1) Cancellation of license (a) Conviction of a crime involving moral turpitude; (b) Conviction of more than one of any of the acts enumerated in No. 2; and (c) Employment/hiring of employees (Tour Guides) who are not holders of license issued by the BPLO or the non-Filipino employees, whether contractual or permanent, without valid working visa and work permit. (2) Suspension of License (a) Any overt act of dishonesty, misrepresentation or misconduct committed against a member of his/her tour group or against his/her employer or co-employee; (b) Forced tipping or contributions from tourists; (c) Failure to comply with the requirements as to the compulsory wearing of identification cards; and (d) Violation of any of the provisions of this Ordinance. cDTACE ARTICLE XX Regulation, Control, and Supervision of Operations of Tourist-Oriented and Tourist-Related Establishments A. Transfer of Certificate of Registration/License . SECTION 61. Transfer of Certificate of Registration/License . The Certificate of Registration/License is a matter of privilege and may be issued only to qualified applicants. Accordingly, no owner and/or operator shall transfer or alienate in any manner said certificate and license without the prior approval of BPLO, Baguio Tourism Council or Department of Tourism. SECTION 62. Display of Certificate of Registration/License and Stickers . The certificate of registration and license shall be displayed in a conspicuous area in their place of business. Stickers shall be posted on entrance/doors, gates of such establishments for easy identification purposes. B. Registration of Guests Resort/Hotel/Apartel/Tourist Inn/Pension House/Lodge . SECTION 63. Registry . Resort/Hotel/Apartel/Tourist Inn/Pension House/Lodge shall keep a registry, a record book or card or a database. All guests/visitors seeking accommodations shall be required to register the following particulars in the registry, record book or card and/or data base. (a) His/Her full name; (b) Particulars of any identity card, passport or other travel documents issued to him/her; (c) The place of his/her origin and his/her permanent, regular or known address and contact number; (d) The probable duration of his/her stay and his/her intended destination; (e) The occupation and place of employment; (f) His/Her nationality; (g) The hour and date of his/her arrival; and (h) The numbers of companions occupying the place of accommodation. SECTION 64. Time of Entry of Particulars . Before the guests/visitors are allowed to occupy a certain room of a resort/hotel/apartel/tourist inn/pension house/lodge and/or its respective premises, the particulars prescribed in the preceding section shall be entered forthwith in the Registry Book, Card or Database, or if he/she is not able to write, by the keepers/managers/clerks and in either case, the entry shall be signed by the guest or if he/she is unable to write it should be authenticated by his/her right thumb print or by any computerized or digital prints. SECTION 65. Visitor Invited by Guest Required to Register . Any visitor invited by a guest to stay in his/her room shall register in a separate book or database for visitors, in which shall be entered the name, address, and other particulars of the visitor. SECTION 66. False Entry in the Registry Book, Card or Database . No manager/operator shall enter or cause to be entered in the registry book, card or database any information or particular, which he knows or could, by the exercise of reasonable diligence, have been ascertained to be false. SECTION 67. Registry of Property Left by Guests . A data storage system in which shall be entered without delay the particular of any property left in any resort/hotel/apartel/tourist inn/pension house/motorist hotel/lodge by any guest shall be kept in a manner which the Baguio Tourism Council may require. SECTION 68. Guest Suffering from Dangerous, Contagious, and/or Infectious Disease . The manager/operator shall immediately report to the City Administrator any guest, tenant or member of any tourism establishment concerned who is found to be suffering from a dangerous, contagious, and/or disease. The City Tourism Officer shall immediately refer the case to the City Health Officer who shall issue the necessary directions/instructions to prevent the spread of the disease or to require the transfer of the patient to the hospital. SECTION 69. Death in the Tourism Establishment . The manager/operator shall immediately report to the nearest police station the death of any person or one dying in a certain "tourism establishment". A copy of the report shall be transmitted to the Baguio Tourism Council. C. Employment of Tourism-Oriented Establishment Personnel SECTION 70. Employment of Foreign Nationals . In the employment of foreign nationals, valid visa and permit to work issued by the Bureau of Immigration and the Department of Labor and Employment, respectively, shall be submitted. cCHITA SECTION 71. Training of Filipino Understudies . Tourism establishments employing foreign national with supervisory, technical or advisory functions shall include in the contract of employment of such foreign nationals a provision on the training of at least two (2) Filipino understudies to whom its foreign national may impart his/her specialized skills. SECTION 72. Submission of Program . The management shall submit to the City Tourism Office within five (5) days from the assumption of duties by the foreign nationals the program for the training Filipinos in discharging the functions of foreign nationals. SECTION 73. Request for Baguio Tourism Council's Identification Cards . The Baguio Tourism Council identification cards shall be issued to employees of tourism establishments upon request subject to payment of nominal fee: Provided, That said employees are included in the list of the tourism establishment concerned. SECTION 74. Surrender of Identification Cards . The manager/operator of a tourist establishment shall require its officers/employees thereof who have ceased to be such to surrender to the management their identification cards. D. Training Program for Staff and Code of Ethics and Conduct. SECTION 75. Training Program for Staff . All tourism establishments shall undertake to provide a staff training program designed to acquaint each member of the staff of his/her duties and responsibilities to the end that such member will know what is expected of him/her. SECTION 76. Code of Ethics and/or Conduct . Tourism establishment managers/operators and/or associations, if any, shall draft, with the assistance of the Baguio Tourism Council, their respective Code of Ethics and/or Conduct which shall govern their conduct in their dealings with one another and the conduct to be observed by the staff or employee towards each other and/or the guests or tenants of the establishment. Such Code of Ethics and/or Conduct shall include the administrative penalties that may be imposed for their violation such as fine, suspension, or dismissal from the service. The said Code of Ethics and/or Conduct once approved by the Baguio Tourism Council shall become part of these rules: Provided, That, in case of conflict between any provision of these rules and said Code of Ethics and/or Conduct, the former shall prevail. E. Reclassification of Hotels . SECTION 77. Promotion/Demotion . A hotel may be promoted or demoted from one class to another as the facts may warrant. SECTION 78. Promotion to a Higher Class . Any hotel, which has upgraded its facilities and services among others, to comply with the requirements of a higher class hotel, may apply with the City Administrator for promotion to such higher class. SECTION 79. Demotion to a Lower Class . Where after due investigation by the Composite Inspection Team it has been established that a hotel is not being kept or managed in a manner conformable to the established standards, the City Tourism Office shall give notice to the hotel manager/operator or such fact granting the hotel a period of time stated in the notice within which to comply with the standard set. If the hotel fails to comply within the period granted in the notice, the Composite Inspection Team shall remove the registration of the hotel from the class and place it in a lower class. F. Transportation Rates (Tourist Transport) . SECTION 80. Manner of Fixing . The fixing of rate for tourist transport shall be the responsibility of the LTFRB. No tourist transport operator shall charge rates other than those so prescribed by the LTFRB. SECTION 81. Application for Increase of Transportation Rates . All applications for the increase of transportation rates shall be filed before the LTFRB. G. Regulation on Tourist Transport Operations . SECTION 82. Tourist Transport Service . Tourist transport service shall be offered on a regular point-to-point run and shall be priced at rates higher than those charged by public utility operators for the same route The points of departure and destination of a tourist transport regularly plying a route shall be a hotel, resort, or such similar tourism facility and picking up or unloading of passengers in between such points is prohibited. SECTION 83. Charter Rates . A tourist transport operator shall charge only charter rates as previously approved in accordance with these rules. CScaDH SECTION 84. Regular Run on Public Utility Bus (PUB) Routes . Where a tourist transport operator makes a regular run and it is the only available service being offered, it may be allowed to run on public utility bus (PUB) routes: Provided, That there is a prior approval by the LTFRB under conditions and requirements it may prescribe. H. Schedule of Charges . SECTION 85. Filing of Schedule of Charges . Tourist establishments shall file their schedule of charges on all services and related fees with the City Tourism Office, copy furnished BTC, and shall be readily made available in printed or mimeographed form. Any change in the charges shall be communicated to the BTC within seven (7) days from the effectivity of such charges. PART FOUR Penal Provisions SECTION 86. Criminal Sanctions . (a) Violation of a Non-Holder of Authority . Any person who is not a holder of a license from the BPLO who violates any of the provisions of this Ordinance shall, upon conviction by a competent court, suffer the penalty of imprisonment not exceeding one (1) year or a fine of not less than Four Thousand Pesos (P4,000.00) nor more than Five Thousand Pesos (P5,000.00) or both at the discretion of the court. (b) Penalty Imposed Upon Officers of Juridical Persons . If the offender of the provisions in the next preceding paragraph hereof is a corporation, partnership, firm or associated, the penalty provided therefor shall be imposed upon the officer responsible for the violation; and if such officer is an alien, he shall, in addition, be subject to deportation. PART FIVE Miscellaneous Provisions SECTION 87. Incentives for Registration of Tourism-Oriented and Tourism-Related Establishment . Tourism-oriented and tourism-related establishments, which are duly registered and licensed by the City Government, shall be entitled to the following incentives: (a) " One-Stop-Shop " processing of registration and license, which should be completed within a period of not exceeding fifteen (15) days. (b) Exemption from the " Liquor Ordinance of Baguio City " as prescribed by law and from Ordinance Numbered 014, Series of 1998, as amended. The exemption shall be strengthened in the Implementing Rules and Regulations of this Ordinance. (c) Inspection by Composite Team of the City Government to be made only once every six (6) months, except in special cases as public interest may require whenever authorized by the City Tourism Office, upon recommendation of the BTC. SECTION 88. Grant of Tax Exemptions and Privileges by the City Council to Tourism Establishments of International Standards . In audition to the privileges, mentioned in the preceding section, the City Council may grant tax exemptions and incentives to tourism establishments of international standards such as, but not limited to, the following: (a) 5-Star De Luxe Hotel; (b) International Convention Center; (c) Man-made resorts or recreational parks of international standard, similar to " Disneyland " or " Ocean Park "; (d) International Film Center/Movie Studio with high-tech, modern equipment and realistic film location sets of international standards similar to " Universal Studios "; and (e) Such similar establishments "to be proposed by the BTC as may be approved by the City Council." The establishments referred to in this section may also apply for the utilization of city government-owned lands through lease agreement or joint venture under terms and conditions, which the City Council may deem proper to impose. SECTION 89. Confidential Character of Certain Data . Information and documents received by or filed with the Baguio Tourism Council in pursuance of the requirements of this Ordinance shall be treated as confidential and shall not be divulged to any private party without the consent of the party concerned when public interest so requires. Any official or employee of the Baguio Tourism Council, including those that are temporarily assigned therewith, who shall violate the provision of the Section shall be guilty of an offense under this Ordinance. SECTION 90. Enlistment of Aid, Assistance and Support of other Government Agencies . In the implementation of the provisions of this Ordinance, the Baguio Tourism Council may enlist the aid, assistance and support of any and all government agencies, whether local or national. aHSTID SECTION 91. Registration and License Form . As the case may be, the Baguio Tourism Council shall make available all applications for registration and/or license forms, and all other forms that may be deemed necessary in the implementation of this Ordinance which shall be accomplished by applicants. SECTION 92. Implementing Rules . The City Mayor may, from time to time, issue rules and regulations as may be deemed necessary in the implementation of this Ordinance. SECTION 93. Funding . The funds necessary for the implementation of this Ordinance shall be provided from the Annual Budget of the City Government. PART SIX Final Provisions SECTION 94. Separability Clause . The provisions of this Ordinance are separable, and in the event any or more of such provisions are declared invalid, the validity of all the other provisions shall not be affected thereby. SECTION 95. Repealing Clause . Any ordinance, executive order, local issuances or rules and regulations, or parts thereof, which are inconsistent with this Ordinance are hereby repealed and/or modified accordingly. SECTION 96. Effectivity . This Ordinance shall take effect in accordance with the provisions of the Local Government Code of 1991. Passed. Hon.
