June 16, 2014 BACOOR CITY ORDINANCE NO. CO 3-2014 AN ORDINANCE AMENDING VARIOUS PROVISIONS OF THE REVISED REVENUE CODE OF THE CITY OF BACOOR, CAVITE Sponsored by: DISTRICT 1 COUNCILORS: Hon. Guerrero, Jr. (ABC President) WHEREAS , City Ordinance No. 2013-060 (otherwise known as the "Revised Revenue Code of the City of Bacoor") took effect on 25 December 2013. WHEREAS , several sectors requested that numerous revisions be made to the various tax rates provided under City Ordinance No. 2013-060 to make the same more responsive to the economic condition of taxpayers. WHEREAS , the Sangguniang Panlungsod conducted several public hearings wherein the merit and legal soundness of the said requests were established. NOW, THEREFORE , the Sangguniang Panlungsod in regular session assembled HEREBY ORDAINS that: SECTION 1. Section 174 of City Ordinance No. 2013-060 is hereby amended and shall henceforth read as follows: " Section 174. Fencing Permit Fee . Fees for fencing permit shall be based on the following rates: a) Fencing of indigenous materials and/or barbed wire, chicken wire, hog wire P2.40 b) Fencing up to 1.80 meters in height made of materials other those mentioned, per lineal meter or fraction thereof P3.00 c) Fencing over 1.80 meter up to the height permitted under the Building Code, per lineal meter P6.00 Section 174.1. Special Survey Permit Fee . In addition to the fencing permit fee, applicants for a fencing permit shall also be required to pay a special survey permit fee of One Hundred Pesos (P100.00). The payment of the said fee shall be a an additional requirement in securing a fencing permit. Before paying the said fee, the applicant shall be required to submit a photocopy of the title covering the lot to be fenced, its latest tax declaration certificate, proof of updated real property tax payments, and a photocopy of the Professional Regulations Commission (PRC) ID of the geodetic engineer who surveyed the said lot with the City Land Titling Unit of the City Engineering Office. " SECTION 2. Section 227 of City Ordinance No. 2013-060 is hereby amended and shall henceforth read as follows: " Section 227. Cemetery Fees . The following cemetery fees shall be collected for the use of all cemetery lots or graves located within the City: a) Permit fees for Cadaver disposition: 1) Registration P200.00 2) Burial permit 200.00 3) For exhumation of cadaver 300.00 4) Removal of cadaver/disinterment 300.00 5) Entrance from other municipality/city 300.00 6) Transfer to other municipality/city 300.00 7) Cremation permit 300.00 8) For construction permit in public/private cemeteries For niche 200.00 For garden terrace (for private cemeteries only) 300.00 For mausoleum (for private cemeteries only) 500.00 9) Utility Fee 50.00 10) Excavation for burial purposes 200.00 11) Transfer of bones 200.00 b) Rental Fees for Public Cemetery Lot or Grave within the Maliksi Public Cemetery: There shall be collected the following rental fees for a lease of five (5) years: 1] For built-in niches Bottom niche P1,600.00 Upper niche 1,500.00 2] Niche constructed over another 200.00 3] Interment in old niche 200.00 4] Lot without niche, adult 20.00 Lot without niche, child 10.00 5] Reopening of niche 30.00 6] Rental of burial lot consisting of the following: 9 sq.m. (3.0 m. x 3.0 m.) 450.00 10 sq.m. (4.0 m. x 2.5 m) 500.00 Renewal every five (5) years 9 sq.m 450.00 10 sq.m 500.00 The following fees shall be charged exclusively for the use of the lots, niches, and graves located at the Molino Public Cemetery: a) For Built-In Niches Bottom Niche P3,000.00 Middle Niche 3,000.00 Upper Niche 3,000.00 b) Rental of burial lot with a minimum area of two (2) and one half (1/2) sq. meters (1m x 2.5) at Five Thousand Pesos (P5,000.00) per square meter. c) Burial Permit P500.00 d) Renewal of lease every five (5) years First Renewal per sq.m. (P3,000.00) Second Renewal per sq.m. (P1,000.00) e) Maintenance Fee per year P400.00 Section 227.1. Special Cemetery Fees for Indigents . Pursuant to the social amelioration agenda of the city government, the following special cemetery fees shall be collected from indigents residing within the City of Bacoor are hereby for the rental of all cemetery lots or graves located within the City for a lease of five (5) years : 1) For built-in niches Bottom niche 1,000.00 Upper niche 1,100.00 2) Niche constructed over another 50.00 3) Interment in old niche 50.00 4) Lot without niche, adult 20.00 Lot without niche, child 10.00 5) Reopening of niche 30.00 6) Rental of burial lot consisting of the following: 9 sq.m. (3.0 m. x 3.0 m.) 350.00 10 sq.m. (4.0 m. x 2.5 m) 450.00 Renewal every five (5) years 9 sq.m. 350.00 10 sq.m. 450.00 The following fees for a base of a cemetery lot and cost of construction of niches located within the public cemetery in Molino shall be collected in favor of indigents : a) For Built-In Niches Bottom Niche P2,000.00 Middle Niche 1,500.00 Upper Niche 1,000.00 b) Rental of burial lot with a minimum are of two (2) and one half (1/2) sq. meters (1m x 2.5) at Two Thousand Five Hundred Pesos (P2,500.00) per square meter . c) Burial Permit P400.00 d) Renewal of lease every five (5) years First Renewal per sq.m. (P2,000.00) per sqm Second Renewal per sq.m. (P1,000.00) per sqm e) Maintenance Fee per year P400.00 per year Section 227.2. Procedure in Availing of the Special Cemetery Fees . The following procedures shall be observed before an indigent can avail of the special cemetery fees contained in Section 227.1. hereof : a] The indigent shall secure the following documents: Certificate of Indigency (from the City Social Welfare and Development Office), Certificate of Residence (from the barangay where he/she resides) and Community Tax Certificate or cedula (from the Office of the City Treasurer) ; b] The indigent shall then submit the original of all the said documents to the Office of the City Treasurer who shall then proceed to collect the special cemetery fees from the said indigent. " SECTION 3. Section 319 of City Ordinance No. 2013-060 is hereby amended and shall henceforth read as follows: " Section 319. Registration Fee for Dogs . Every person who owns or keeps a dog shall register the same with the Office of the City Veterinarian , who shall issue the necessary permit upon payment of an annual registration fee of One Hundred Pesos (P100.00) , per dog, to be paid to the City Treasurer upon an order of payment issued by the City Veterinarian within the first twenty (20) days of January each year. The permit fee for dogs acquired after January 20 shall be paid within the first twenty (20) days following the date of its acquisition. The owner or keeper of any dog required to be licensed under this Article shall provide a collar and leash and shall furthermore muzzle the dog when needed . Section 319.1. Additional Fees for Owners of Dogs and Cats . The following additional fees shall be collected from the owners of dogs and cats who chooses to avail of the following services from the City Veterinarian Office : 1. Health Certificate - 350.00 (to be paid only when the pet shall accompany its owner while travelling abroad) 2. Earcleaning - 150.00 3. Earcleaning with Otitis - 300.00 4. Nail clipping - 100.00 5. Mange Injection - 350.00 6. Treatment: Small breed (up to 10kgs) - 250.00 Medium breed (11kgs-20kgs) - 350.00 Large breed (21kgs-40kgs) - 500.00 7. Forcible Sterilization Fee: Dogs (male) - 1,000.00 (female) - 1,500.00 Cats (male) - 500.00 (female) - 1,000.00" SECTION 4. Repealing Clause . All existing ordinances, resolutions, and executive orders that are in conflict with, or that duplicates this ordinance or any of its provisions are hereby repealed and/or modified accordingly. SECTION 5. Separability Clause . If any provision of this Ordinance or the application thereof to any person or circumstance is held invalid, the remainder of the ordinance, and the application of such provision to other persons or circumstances, shall not be affected thereby. SECTION 6. Effectivity . This ordinance shall take effect immediately after its publication at least once in a local newspaper of general circulation. SECTION 7. Dissemination . Let copies of this Ordinance be sent to the Office of the City Mayor and to all government departments, agencies, and offices concerned.
