An Ordinance Amending Sections 1 and 2 (Par. 7) of Article V of Ordinance No. 216, Series of 1998, Otherwise Known as "The Comprehensive Zoning Ordinance of the City of Bacolod"

June 18, 2014 BACOLOD CITY ORDINANCE NO. 08-14-676 AN ORDINANCE AMENDING SECTIONS 1 AND 2 (PAR. 7) OF ARTICLE V OF ORDINANCE NO. 216, SERIES OF 1998, OTHERWISE KNOWN AS "THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF BACOLOD" WHEREAS, Section 10, Article XI of Ordinance No. 216, series of 1998, otherwise known as the "Comprehensive Zoning Ordinance of the City of Bacolod" authorizes changes in the Zoning Ordinance to correct and amend or modify some provisions as the need arises; WHEREAS, there is a need to clarify and correct Sections 1 and 2 (paragraph 7), Article V, of Ordinance No. 216, series of 1998, as amended, in order to harmonize and reconcile the Official Zoning Map and the textual description of the classification and zone boundaries of Barangays 4 and 8 in Bacolod City under said Ordinance for the development of the affected areas that will inure to the benefit of the City of Bacolod and the Province of Negros Occidental; WHEREAS, the Guidelines for the Formulation/Revision of a Comprehensive Land Use Plan of the Housing and Land Use Regulatory Board dated November 11, 1996 provides that "The textual description of the zone boundaries shall prevail over that of the Official Zoning Maps." NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Bacolod in session assembled, that: SECTION 1. The zoning classification of Barangays 4 and 8 of Bacolod City as "Commercial" is hereby confirmed but the textual description of the zone boundaries as described in Section 1, Article V of Ordinance No. 216, series of 1998, as amended is hereby amended to read as follows: "Barangay 4 2. A rectangular block bounded on the north by North Drive, Lacson Street on the east, North Capitol Road on the south and Aguinaldo Street on the west is declared as Commercial-1. Barangay 8 1. The whole territorial jurisdiction of Barangay 8 is declared as Commercial-2". SECTION 2. The Official Zoning Map that forms part of Ordinance No. 216 is hereby corrected and amended to be consistent with the Zone Boundaries as described in Section 1 hereof. SECTION 3. To resolve any doubt or conflict, paragraph 7, Section 2, Article V on the "Interpretation of the Zone Boundary" of said Ordinance No. 216, series of 1998, as amended, is hereby amended to read as follows: "7. The textual description of the zone boundaries in Ordinance No. 216, series of 1998, shall prevail over the Official Zoning Map of Bacolod City. Accordingly, should there be any conflict, the City Planning Officer is hereby directed to effect the necessary corrections to the Official Zoning Map to make it conform with the textual description of the zone boundaries in the Ordinance No. 216, series of 1998, as amended." SECTION 4. Any provision of Ordinance No. 216, series of 1998, as amended, or the "Comprehensive Zoning Ordinance of the City of Bacolod" or other ordinances of the City of Bacolod that may be in conflict with this Ordinance shall be repealed, modified or amended accordingly. SECTION 5. The provisions of Ordinance No. 216, series of 1998, as amended, or the "Comprehensive Zoning Ordinance of the City of Bacolod" or other ordinance of the City of Bacolod not affected, repealed or modified by the provisions of this Ordinance shall remain valid and enforceable.
