An Ordinance Amending the Revised Revenue Code of Antipolo City

June 5, 2017 ANTIPOLO CITY ORDINANCE NO. 761-17 AN ORDINANCE AMENDING THE REVISED REVENUE CODE OF ANTIPOLO CITY TO INCLUDE THE COLLECTION OF FILING FEES, AND ALL OTHER LITIGATION EXPENSES OF THE CITY GOVERNMENT OF ANTIPOLO, IN CONNECTION WITH THE FILING OF ANY JUDICIAL ACTION FOR THE COLLECTION OF UNPAID TAXES LEVIED UNDER THE REVISED REVENUE CODE OF ANTIPOLO CITY (ADMINISTRATION MEASURE) INTRODUCED & SPONSORED BY: ALL S. MEMBERS WHEREAS , on 13 December 2000, the Sangguniang Panlungsod, through City Resolution No. 206-C-2000 approved and enacted City Ordinance No. 65-2000 otherwise known as the Revised Revenue Code of Antipolo City; HTcADC WHEREAS , Item letter (n), Section 6B.02, Chapter VI of the Revised Revenue Code of Antipolo City grants the City Government of Antipolo the power to initiate a judicial action as one of its civil remedies for collection of revenue; WHEREAS , in filing judicial actions for the collection of contractor's tax, the City Government of Antipolo is constrained to defray expenses, for filing fees, summons fees, posting fee, Sheriff Trust Fund fee, mediation fee, and other fees required by the Judiciary; WHEREAS , Section 1, Rule 142 of the Rules of Court provides: Section 1. Cost ordinarily follow results of suit . Unless otherwise provided in these rules, cost shall be allowed to the prevailing party as a matter of course, but the court shall have power, for special reasons, to adjudge that either party shall pay the costs of an action, or that the same be divided, as may be equitable. No costs shall be allowed against the Republic of the Philippine unless otherwise provided by law. CAIHTE WHEREAS , the Revised Revenue Code of Antipolo does not prescribe for the manner of charging delinquent taxpayers for the judicial costs that the City Government may incur in the filing of judicial actions for collection of revenue; WHEREAS, FINALLY , under the above-stated circumstances, there is an urgent need for the amendment of the Revised Revenue Code of Antipolo City, in order to authorize the collection of judicial costs and other litigation expenses to be incurred by the City Government in filing any judicial action for the collection of revenue against delinquent taxpayers. NOW THEREFORE , the Sangguniang Panlungsod, in accordance with the powers granted by the LGC and its Charter hereby promulgates the following: aScITE SECTION 1. A new paragraph under Item (n), Section 6B.02, Chapter VI of the Revised Revenue Code of Antipolo is hereby inserted, to read as follows: "Any and all fees and/or to be incurred in any judicial action filed by the City Government pursuant to the preceding paragraph, including but not limited to, filing fees, summons fees, sheriff's fees, mediation fees, and posting fees, shall be included in the total amount to be charged and collected against delinquent taxpayer/entity." SECTION 2. Repealing Clause . The pertinent provisions of City Ordinance No. 65-2000 and all other Ordinances and Resolutions of the City Government of Antipolo, or any part thereof inconsistent with the provision of this Ordinance, are hereby repealed or modified accordingly. SECTION 3. Effectivity . This Ordinance shall take effect immediately after three consecutive publications in a newspaper of general circulation.
