Say Pres., SK Federation GUEST: None ANTIPOLO CITY ORDINANCE NO. 2009-321-A AN ORDINANCE AUTHORIZING THE OFF-SETTING OF THE TAX LIABILITY OF PECSON AGRO-INDUSTRIAL & REALTY DEVELOPMENT CORPORATION WITH THE CITY GOVERNMENT OF ANTIPOLO THRU THE DACION EN PAGO SCHEME, I.E., BY ASSIGNING IN FAVOR OF THE CITY THE OWNERSHIP OVER SUCH PROPERTY SUFFICIENT IN VALUE TO COVER ITS TAX LIABILITY TOGETHER WITH INTERESTS AND OTHER CHARGES, AND FOR OTHER PURPOSES Introduced by: Coun. Jesus Angelito Y. Huertas, Jr. Sponsored by: Comm. on Housing and Land Utilization WHEREAS, Mr. Juanito E. Pecson, President of Pecson Agro-Industrial and Realty Development Corp., with address at No. 45 F. Oldan St., Mayamot, Antipolo City, is the owner of several parcels of land located at Sitio Aduas Pinugay, Barangay San Jose, Antipolo City, embraced in several Transfer Certificate of Titles (TCTs), containing an aggregate area of 116,187 square meters, more or less; cTIESD WHEREAS, Mr. Pecson has already signified his willingness and intention to sell to the City of Antipolo his abovementioned land holdings at the price of Php500.00 per square meter to assist the city in addressing the acute housing needs of its constituents as well as issues and other concerns arising from the lack of relocation sites for the informal settlers in the city; WHEREAS, notwithstanding such sincere offer, Pecson Agro-Industrial and Realty Development Corporation has an outstanding tax liability to the City amounting to Php971,575.50, and in order to settle his tax obligation, Mr. Pecson has proposed to assign in favor of the city, the ownership over such parcel or parcels of land the value of which would be sufficient to cover its tax liabilities together with accrued interests and other charges, under what is known as dacion en pago scheme; WHEREAS, the same subject matter was subsequently referred to the Committee on Housing and Land Utilization for appropriate action and the said committee, after careful study and due evaluation, has determined that Mr. Pecson is willing to transfer the administration over his landholdings in favor of the city with the end in view of ultimately selling his property to the City, and that Mr. Pecson is offering the property described as Block 1 Lots 10 & 11 with each lot having an area of 1,000 sq.m., as payment for tax obligations; WHEREAS, considering the merit of Mr. Pecson's proposal, as well as his noble intention of extending assistance to the city in addressing the housing and urban poor settlement problems in the city, this august body has recognized the necessity of enacting this Ordinance. NOW THEREFORE, BE IT ENACTED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT: SECTION 1. For the purposes of this Ordinance, the tax liability of Pecson Agro-Industrial and Realty Development Corporation, with address at No. 45 F. Oldan St., Brgy. Mayamot, Antipolo City, represented by its President, Mr. Jovito E. Pecson, amounting to Php971,575.50, is hereby off-set by assigning the ownership in favor of the city, the parcel of land situated at Pantay, Brgy. San Jose, Antipolo City, described in TCT No. 246651 as block 1, lots 10 and 11, with each lot containing an area of 1,000 square meters or a total of 2,000 square meters: Provided, however, that the value of the said lots 10 and 11 would be sufficient to cover all the tax liabilities of Pecson Agro-Industrial and Realty Development Corporation: Provided, further, that in the event the value of these two lots, i.e. , lots 10 and 11 are not sufficient, Pecson Agro-Industrial and Realty Development Corporation shall assign the ownership in favor of the City over such property until all its tax liabilities are fully and adequately settled: Provided, finally, that nothing in this Ordinance shall prevent both parties from exploring all other possibilities in order to ensure that the tax liabilities of the taxpayer are fully and adequately settled. ICcDaA SECTION 2. This ordinance shall take effect upon its approval.
